India Plans Tax Relief Till 2041 For Apple Suppliers To Boost Electronics Manufacturing And Exports

New Delhi: In a significant policy move aimed at strengthening India’s position as a global electronics manufacturing hub, the Centre has proposed extending tax exemptions until March 3,1 20,41 for foreign companies that supply machinery to their contract manufacturers in the country.

The proposal is expected to provide a major advantage to Apple,ple which had sought changes in India’s tax framework while rapidly expanding its manufacturing footprint.

India has emerged as one of Apple’s fastest-growing production bases as the technology giant continues to reduce its dependence on China for iPhone manufacturing.

According to Counterpoint Research, arch India’s share in global iPhone production is projected to climb to 26 per cent in 2026 from only 6 per cent four years earlier, reflecting the country’s growing importance in Apple’s supply chain.

A draft of the proposed tax amendments reviewed by Reuters states that the extension has been designed to provide long-term tax certainty for overseas companies that provide production equipment to their contract manufacturing partners operating in India.

Under the proposal, the exemption would remain available until the end of March 2041.

The government had originally introduced this tax benefit in February with validity up to 2031.

The decision came after Apple urged New Delhi to amend income tax provisions to ensure that ownership of sophisticated manufacturing equipment supplied to its Indian contract manufacturers would not expose the company to additional tax liabilities.

Apple had expressed concerns that Indian tax regulations could classify the ownership of machinery supplied to manufacturing partners as a “business connection,n” unlike the tax treatment in China.

Such an interpretation could potentially subject the company’s profits from iPhone production to taxation in India.

According to the draft legislation, the proposed extension will cover overseas companies supplying equipment for the production of mobile phones,nes tablets, laptops, hearing devices,s and wearable electronic products.

The amendments will become effective only after receiving approval from both Houses of Parliament.

The draft proposal also provides tax relief until 2041 on income earned by foreign companies from storing and supplying components used in the manufacture of these electronic products to contract manufacturers located in India.

These incentives will apply to factories and warehouses established in customs-bonded zones which are treated as being outside India’s customs territory for specific trade purposes.

Products exported from such facilities will enjoy the benefits,s while goods sold within the domestic market will continue to attract import duties, es making the arrangement more suitable for export-oriented manufacturing.

The proposed amendments are intended to encourage global companies to maintain critical machinery and essential components within India for use by their manufacturing partners.

The government believes the changes will strengthen supply chain resilience, reduce disruptions arising from international trade uncertainties, and provide greater predictability under the country’s tax regime.

In another important proposal, the government has also moved to simplify tax benefits for foreign companies that use Indian data centres to deliver services to customers around the world.

Earlier this year,r India had announced a tax exemption until 2047 for overseas companies using data centres located in the country for global operations.

The objective was to address concerns that future tax rules could expose their worldwide income to Indian taxation merely because they relied on data centre infrastructure in the country.

The latest draft legislation further proposes that Indian partners may lease data centres instead of owning them.

The change is expected to provide greater operational flexibility for foreign businesses entering the Indian market.

According to Thingna of Grant Thornton Bhar,t permitting leased data centres instead of mandatory ownership will substantially reduce capital investment requirements.

The move is also expected to encourage greater participation by small and medium-sized companies in India’s expanding digital infrastructure sector. Separately, the government has proposed a fresh tax incentive for the diamond industry.

Under the proposal, foreign diamond mining companies and traders selling rough diamonds through notified trading zones in India would receive a tax exemption for 15 years.

The measure is expected to strengthen India’s position as the world’s leading centre for diamond cutting and polishing.

नई दिल्ली: भारत को वैश्विक इलेक्ट्रॉनिक्स विनिर्माण केंद्र के रूप में और अधिक मजबूत बनाने की दिशा में केंद्र सरकार ने विदेशी कंपनियों को बड़ी कर राहत देने का प्रस्ताव रखा है।

सरकार ने सुझाव दिया है कि भारत में अपने कॉन्ट्रैक्ट मैन्युफैक्चरर्स को मशीनरी उपलब्ध कराने वाली विदेशी कंपनियों के लिए कर छूट की अवधि 31 मार्च 2041 तक बढ़ाई जाए।

इस कदम से विशेष रूप से एप्पल को बड़ा लाभ मिलने की संभावना है जिसने इस संबंध में कर नियमों में बदलाव की मांग की थी।

चीन पर अपनी उत्पादन निर्भरता कम करने की रणनीति के तहत एप्पल तेजी से भारत में आईफोन निर्माण का विस्तार कर रहा है।

काउंटरपॉइंट रिसर्च के अनुसार वर्ष 2026 तक दुनिया में बनने वाले कुल आईफोनों में भारत की हिस्सेदारी बढ़कर 26 प्रतिशत तक पहुंचने का अनुमान है जबकि चार वर्ष पहले यह केवल 6 प्रतिशत थी।

रॉयटर्स द्वारा देखे गए प्रस्तावित कर संशोधन के मसौदे में कहा गया है कि विदेशी कंपनियों को दीर्घकालिक कर स्पष्टता उपलब्ध कराने के उद्देश्य से यह छूट 2041

तक बढ़ाने का प्रस्ताव रखा गया है। यह सुविधा उन विदेशी कंपनियों को मिलेगी जो भारत स्थित अपने कॉन्ट्रैक्ट मैन्युफैक्चरिंग साझेदारों को उत्पादन उपकरण उपलब्ध कराती हैं।

सरकार ने यह कर राहत पहली बार इस वर्ष फरवरी में लागू की थी जिसकी अवधि वर्ष 2031 तक निर्धारित की गई थी।

यह निर्णय एप्पल द्वारा आयकर कानूनों में संशोधन की मांग के बाद लिया गया था ताकि भारतीय कॉन्ट्रैक्ट मैन्युफैक्चरर्स को उपलब्ध कराई गई अत्याधुनिक मशीनरी के स्वामित्व के कारण कंपनी पर अतिरिक्त कर दायित्व न आए।

एप्पल को आशंका थी कि भारत के कर नियम चीन से अलग तरीके से मशीनरी के स्वामित्व को “बिजनेस कनेक्शन” के रूप में देख सकते हैं। यदि ऐसा होता तो भारत में आईफोन निर्माण से जुड़े कंपनी के मुनाफे पर कर लगाए जाने की संभावना बन सकती थी।

मसौदा विधेयक के अनुसार प्रस्तावित कर छूट मोबाइल फोन टैबलेट लैपटॉप श्रवण उपकरण तथा पहनने योग्य इलेक्ट्रॉनिक उत्पादों के निर्माण में उपयोग होने वाली मशीनरी उपलब्ध कराने वाली विदेशी कंपनियों पर लागू होगी।

हालांकि इस व्यवस्था को प्रभावी होने से पहले संसद के दोनों सदनों की मंजूरी प्राप्त करनी होगी।

सरकार ने इलेक्ट्रॉनिक्स निर्माण में प्रयुक्त पुर्जों के भंडारण और उन्हें कॉन्ट्रैक्ट मैन्युफैक्चरर्स तक उपलब्ध कराने से होने वाली विदेशी कंपनियों की आय को भी वर्ष 2041 तक कर मुक्त रखने का प्रस्ताव किया है।

यह सुविधा उन कारखानों और गोदामों पर लागू होगी जो कस्टम्स बॉन्डेड क्षेत्रों में स्थापित किए गए हैं।

इन क्षेत्रों को सीमा शुल्क व्यवस्था के तहत विशेष दर्जा प्राप्त है। ऐसे परिसरों से निर्यात किए जाने वाले उत्पादों को लाभ मिलेगा जबकि घरेलू बाजार में बेचे जाने वाले सामान पर आयात शुल्क लागू रहेगा।

इससे यह व्यवस्था मुख्य रूप से निर्यात आधारित विनिर्माण के लिए अधिक आकर्षक बनेगी।

सरकार का मानना है कि इन संशोधनों से वैश्विक कंपनियां भारत में अपने विनिर्माण साझेदारों के लिए आवश्यक मशीनरी और महत्वपूर्ण पुर्जों का सुरक्षित भंडारण कर सकेंगी।

इससे वैश्विक व्यापार से जुड़ी अनिश्चितताओं के दौरान आपूर्ति श्रृंखला अधिक मजबूत होगी और कंपनियों को दीर्घकालिक कर स्थिरता भी मिलेगी।

सरकार ने एक अन्य महत्वपूर्ण प्रस्ताव के तहत भारत में डेटा सेंटर सेवाओं का उपयोग करने वाली विदेशी कंपनियों के लिए कर छूट संबंधी प्रावधानों को भी अधिक सरल बनाने की पहल की है।

फरवरी में सरकार ने भारत स्थित डेटा सेंटरों के माध्यम से वैश्विक ग्राहकों को सेवाएं देने वाली विदेशी कंपनियों को वर्ष 2047 तक कर छूट देने की घोषणा की थी।

इसका उद्देश्य यह आशंका दूर करना था कि भविष्य में केवल भारत के डेटा सेंटरों का उपयोग करने के आधार पर उनकी वैश्विक आय पर कर लगाया जा सकता है।

अब प्रस्तावित विधेयक में यह भी प्रावधान किया गया है कि विदेशी कंपनियों के भारतीय साझेदार डेटा सेंटरों के स्वामी बनने के बजाय उन्हें लीज पर भी ले सकेंगे।

इससे विदेशी निवेशकों के लिए कारोबार शुरू करना अधिक आसान होगा।

ग्रांट थॉर्नटन भारत के थिंगना के अनुसार डेटा सेंटरों को स्वामित्व के बजाय लीज पर लेने की अनुमति मिलने से शुरुआती पूंजीगत निवेश में उल्लेखनीय कमी आएगी।

इससे छोटे और मध्यम स्तर की कंपनियों के लिए भी इस क्षेत्र में प्रवेश करना अधिक सरल हो जाएगा।

इसके अलावा सरकार ने हीरा उद्योग के लिए भी नई कर राहत का प्रस्ताव रखा है। प्रस्ताव के अनुसार भारत के अधिसूचित ट्रेडिंग क्षेत्रों के माध्यम से कच्चे हीरों की बिक्री करने वाली विदेशी खनन कंपनियों और कारोबारियों को 15 वर्ष की कर छूट मिलेगी।

यह कदम हीरा कटिंग और पॉलिशिंग के वैश्विक केंद्र के रूप में भारत की स्थिति को और मजबूत करने की दिशा में महत्वपूर्ण माना जा रहा है.
