Muzaffarnagar Judge Ravi Kumar Diwakar Says He Would Rather Die Than Be Called a Coward
After 97 murder cases were transferred from his court, the judge says he will continue to uphold his principles without yielding to criminals or strongmen.
MUZAFFARNAGAR: Additional District and Sessions Judge Ravi Kumar Diwakar has made a strong assertion about judicial independence, saying he would prefer death to being branded a “coward” for surrendering to pressure from mafias, criminals or influential strongmen.
The remarks came in a Hindi-language judgment delivered on September 7 in a dowry death case, in which Diwakar awarded the accused the death penalty.
In the judgment, the judge referred to the principles that have guided him throughout his judicial career and said he would not allow fear of any individual or criminal force to influence his decisions.
Diwakar said his parents had taught him from an early age that his fear should be reserved for God and not for people.
He argued that allowing intimidation by powerful individuals to affect judicial functioning would conflict with the faith ordinary citizens place in courts when they approach them seeking justice.
The judge further stated that if he ever became afraid of external forces, resigning
g from the “sacred” judicial institution would be the more appropriate course.
He maintained that while occupying the judicial chair, the responsibility and authority to decide cases rested with him, and that he intended to remain in service for as long as he could act according to his convictions.
His comments come against the backdrop of an unusually high number of capital punishment verdicts delivered by his court.
Diwakar, who presided over Fast Track Court No. 3 in Muzaffarnagar, awarded 22 death sentences in 10 cases over a period of about four months.
A recent administrative order has also brought changes to the cases pending before his court.
An order issued by the Muzaffarnagar District and Sessions Judge on August 18 shows that 97 pending murder cases were recalled from Diwakar’s court and transferred elsewhere.
The order contains the case titles of all 97 matters.
Earlier reports had highlighted the pace at which Diwakar’s court handed down death sentences.
Between April 6 and July 17, 17 people were sentenced to death in seven murder trials, involving 22 accused, according to the reported figures.
The death penalties awarded by a Sessions Court do not automatically become executable.
Under Sections 407 to 412 of the Bharatiya Nagarik Suraksha Sanhita, a capital punishment order requires confirmation by the High Court before it can be carried out.
Consequently, the death sentences from the Muzaffarnagar court will be placed before the Allahabad High Court, while convicted persons may separately pursue appeals.
Diwakar entered the Uttar Pradesh judicial service in 2009 as a civil judge. His postings have included Sultanpur, Budaun, Varanasi and Bareilly.
He has been serving in Muzaffarnagar since November 2025.
The judge had previously attracted considerable public attention in 2022 while posted in Varanasi.
At that time, he ordered a videographic survey of the Gyanvapi mosque complex.
He subsequently said that he received threatening calls and messages following the order, including communications originating from international numbers.
His latest remarks therefore come amid both administrative developments concerning his court and continued attention surrounding his judicial decisions, particularly those involving capital punishment.

मुजफ्फरनगर: मुजफ्फरनगर के अतिरिक्त जिला एवं सत्र न्यायाधीश रवि कुमार दिवाकर ने न्यायिक स्वतंत्रता को लेकर अपने रुख को बेहद स्पष्ट शब्दों में सामने रखा है।
दहेज हत्या के एक मामले में 7 सितंबर को फैसला सुनाते हुए उन्होंने कहा कि वह माफिया, अपराधियों या बाहुबलियों के दबाव के आगे झुककर “कायर जज” कहलाने के बजाय मरना पसंद करेंगे।
हिंदी में लिखे गए फैसले में न्यायाधीश ने अपने व्यक्तिगत सिद्धांतों और न्यायिक जिम्मेदारी का उल्लेख किया।
उन्होंने कहा कि बचपन से ही उनके माता-पिता ने उन्हें यह सीख दी कि डर केवल ईश्वर से होना चाहिए, किसी व्यक्ति या ताकतवर समूह से नहीं।
दिवाकर ने अपने आदेश में यह भी कहा कि यदि कभी उन्हें बाहरी ताकतों से भय लगने लगे और उसके कारण न्यायिक दायित्व प्रभावित हो, तो ऐसी स्थिति में इस पवित्र न्यायिक संस्था से इस्तीफा देना उनके लिए अधिक उचित होगा।
उनका कहना था कि जब तक वह न्यायाधीश की कुर्सी पर हैं, मामलों में निर्णय लेने का अधिकार उनका अपना रहेगा।
न्यायाधीश की यह टिप्पणी ऐसे समय आई है जब उनके न्यायालय द्वारा पिछले कुछ महीनों में बड़ी संख्या में मौत की सजा सुनाए जाने को लेकर चर्चा हुई है।
फास्ट ट्रैक कोर्ट नंबर-3 की अध्यक्षता करते हुए दिवाकर ने करीब चार महीने में 10 मामलों में 22 दोषियों को मृत्युदंड सुनाया।
इसी बीच उनके न्यायालय में लंबित मुकदमों को लेकर भी प्रशासनिक स्तर पर बड़ा बदलाव हुआ है।
मुजफ्फरनगर के जिला एवं सत्र न्यायाधीश की ओर से 18 अगस्त को जारी आदेश के अनुसार, दिवाकर की अदालत में लंबित 97 हत्या के मुकदमों को वापस लेकर दूसरे न्यायालयों में स्थानांतरित किया गया। आदेश में इन मामलों के शीर्षक भी दर्ज हैं।
दिवाकर की अदालत में मृत्युदंड दिए जाने की रफ्तार इससे पहले भी चर्चा में रही थी।
उपलब्ध विवरण के अनुसार, 6 अप्रैल से 17 जुलाई के बीच लगभग 100 दिनों की अवधि में सात अलग-अलग हत्या के मुकदमों में 17 लोगों को मौत की सजा सुनाई गई थी। इन मामलों में कुल 22 आरोपी शामिल थे।
हालांकि सत्र अदालत द्वारा सुनाई गई मृत्युदंड की सजा तत्काल लागू नहीं की जा सकती।
भारतीय नागरिक सुरक्षा संहिता की धारा 407 से 412 के तहत ऐसी सजा पर हाई कोर्ट की पुष्टि आवश्यक होती है।
इस प्रक्रिया के तहत मुजफ्फरनगर अदालत द्वारा सुनाई गई मौत की सजाएं इलाहाबाद हाई कोर्ट के समक्ष जाएंगी। दोषी व्यक्ति अपनी ओर से अपील भी दायर कर सकते हैं।
रवि कुमार दिवाकर ने 2009 में सिविल जज के रूप में उत्तर प्रदेश न्यायिक सेवा में प्रवेश किया था। सेवा के दौरान उनकी तैनाती सुल्तानपुर, बदायूं, वाराणसी और बरेली समेत कई जिलों में रही। नवंबर 2025 से वह मुजफ्फरनगर में तैनात हैं।
वह 2022 में वाराणसी में तैनाती के दौरान राष्ट्रीय स्तर पर भी चर्चा में आए थे।
उस समय उन्होंने ज्ञानवापी मस्जिद परिसर का वीडियोग्राफिक सर्वे कराने का आदेश दिया था।
बाद में उन्होंने बताया था कि इस आदेश के बाद उन्हें धमकी भरे फोन और संदेश मिले थे, जिनमें कुछ अंतरराष्ट्रीय नंबरों से भी आए थे।
अब उनका ताजा बयान न्यायिक कार्यप्रणाली, उनके न्यायालय से जुड़े प्रशासनिक फैसलों और उनके द्वारा सुनाई गईं मौत की सजाओं को लेकर जारी चर्चा के बीच सामने आया है।
