President Gives Nod to Maharashtra Anti-Conversion Law, State Awaits Notification for Rollout
A major legislative measure aimed at regulating religious conversions in Maharashtra has moved a decisive step closer to implementation after securing the approval of President Droupadi Murmu.
With the constitutional process now complete, the enactment is awaiting only a formal notification from the state government before it becomes operational.
Senior government sources confirmed that the President has accorded assent to the Maharashtra Freedom of Religion Act, 2026, popularly described as the state’s anti-conversion legislation.
Following the approval, Maharashtra Governor C P Radhakrishnan has formally communicated the decision to the state administration for the next stage of the process.
According to officials familiar with the development, the Governor has transmitted the approved legislation to the Maharashtra government, which will now issue the mandatory notification bringing the law into force.
The administration is expected to determine the implementation date after completing procedural formalities.
Although presidential approval has been granted, the statute will not become legally enforceable immediately. Its provisions will acquire legal effect only from the date specified in the official notification to be issued by the state government.
The proposed legislation completed its legislative journey earlier this year after being endorsed by the Maharashtra Assembly during the Budget Session.
It was subsequently approved by the Legislative Council before being forwarded to the Governor and thereafter to the President for constitutional assent.
Designed to prevent unlawful religious conversions, the law prohibits conversion achieved through force, deception, inducement, false representation or promises linked to marriage.
It also makes it compulsory for individuals intending to convert to submit a notice to the District Magistrate at least 60 days in advance.
Apart from laying down procedural safeguards, the Act empowers parents, siblings and other close relatives to file complaints regarding disputed conversions.
It also places the responsibility of establishing that a conversion took place voluntarily upon the individual facilitating the religious conversion.
The legislation prescribes stringent penalties for violations.
Anyone found guilty under its provisions can face imprisonment extending up to seven years, while repeat offenders may be punished with a jail term of as much as ten years.
Passage of the Bill had triggered an intense political confrontation in the Maharashtra Legislature.
The ruling Mahayuti coalition strongly defended the measure, whereas the Congress, the Nationalist Congress Party (Sharad Pawar faction) and the Samajwadi Party opposed it.
Shiv Sena (Uddhav Balasaheb Thackeray) extended its support to the proposed law.
While defending the measure during the Budget Session, Chief Minister Devendra Fadnavis had asserted that the objective of the legislation was to check conversions secured through coercion or dishonest means.
He maintained that the law neither targeted voluntary changes of faith nor sought to interfere with interfaith marriages entered into by consenting adults.

महाराष्ट्र में धार्मिक परिवर्तन को विनियमित करने के उद्देश्य से बनाया गया महत्वपूर्ण कानून अब लागू होने की दहलीज पर पहुंच गया है।
राष्ट्रपति द्रौपदी मुर्मु की मंजूरी मिलने के साथ इसकी संवैधानिक प्रक्रिया पूरी हो चुकी है और अब इसे प्रभावी बनाने के लिए राज्य सरकार की अधिसूचना जारी होना बाकी है।
उच्च पदस्थ सरकारी सूत्रों के अनुसार, राष्ट्रपति ने महाराष्ट्र स्वतंत्रता धर्म अधिनियम, 2026 को अपनी स्वीकृति प्रदान कर दी है।
इसके बाद राज्यपाल सी. पी. राधाकृष्णन ने विधेयक को आगे की कार्रवाई के लिए महाराष्ट्र सरकार को भेज दिया है।
सूत्रों का कहना है कि राज्य सरकार अब आधिकारिक अधिसूचना जारी कर इस कानून के लागू होने की तिथि निर्धारित करेगी। अधिसूचना कब जारी की जाएगी, इसका निर्णय प्रशासनिक स्तर पर लिया जाएगा।
राष्ट्रपति की मंजूरी मिलने के बावजूद यह कानून तत्काल प्रभाव से लागू नहीं होगा। इसकी सभी धाराएं उसी दिन से प्रभावी मानी जाएंगी, जिस दिन राज्य सरकार राजपत्र में इसकी अधिसूचना जारी करेगी।
इस विधेयक ने इसी वर्ष बजट सत्र के दौरान महाराष्ट्र विधानसभा से पारित होकर अपनी विधायी प्रक्रिया शुरू की थी। बाद में इसे विधान परिषद की भी मंजूरी मिली, जिसके पश्चात इसे राज्यपाल और फिर राष्ट्रपति के अनुमोदन के लिए भेजा गया था।
धर्मांतरण से जुड़े कथित दुरुपयोग पर रोक लगाने के उद्देश्य से तैयार इस कानून में बल प्रयोग, छल, प्रलोभन, गलत प्रस्तुतीकरण अथवा विवाह का वादा करके कराए जाने वाले धर्म परिवर्तन पर प्रतिबंध लगाया गया है।
साथ ही धर्म परिवर्तन करने से पहले संबंधित व्यक्ति को कम से कम 60 दिन पूर्व जिला मजिस्ट्रेट को सूचना देना अनिवार्य किया गया है।
कानून में यह व्यवस्था भी की गई है कि यदि किसी धर्म परिवर्तन को लेकर विवाद उत्पन्न होता है तो परिवर्तित व्यक्ति के माता-पिता, भाई-बहन अथवा अन्य निकट संबंधी शिकायत दर्ज करा सकते हैं।
इसके अलावा यह साबित करने का दायित्व धर्म परिवर्तन कराने वाले व्यक्ति पर होगा कि परिवर्तन पूरी तरह स्वेच्छा से किया गया था।
इस अधिनियम के उल्लंघन पर कठोर दंड का प्रावधान किया गया है। दोषी पाए जाने पर अधिकतम सात वर्ष तक के कारावास की सजा हो सकती है, जबकि दोबारा अपराध करने वालों के लिए यह अवधि बढ़ाकर दस वर्ष तक निर्धारित की गई है।
विधानमंडल में पेश किए जाने के समय इस विधेयक को लेकर तीखी राजनीतिक बहस देखने को मिली थी। सत्तारूढ़ महायुति गठबंधन ने इसका जोरदार समर्थन किया, जबकि कांग्रेस, राष्ट्रवादी कांग्रेस पार्टी (शरद पवार गुट) और समाजवादी पार्टी ने इसका विरोध किया।
वहीं शिवसेना (उद्धव बालासाहेब ठाकरे) ने इस विधेयक के पक्ष में अपना समर्थन व्यक्त किया।
बजट सत्र के दौरान कानून का बचाव करते हुए मुख्यमंत्री देवेंद्र फडणवीस ने स्पष्ट किया था कि इस पहल का उद्देश्य केवल बलपूर्वक अथवा धोखाधड़ी के माध्यम से कराए जाने वाले धर्मांतरण पर रोक लगाना है।
उन्होंने कहा था कि यह कानून स्वेच्छा से किए जाने वाले धर्म परिवर्तन या आपसी सहमति से होने वाले अंतरधार्मिक विवाहों के खिलाफ नहीं है।
