Rampur: Demolition Ordered for 38 Buildings at Mohammad Ali Jauhar University, Samajwadi Party Calls Action ‘Selective’
Rampur: A major administrative action has been initiated against Mohammad Ali Jauhar University in Rampur after the Rampur Development Authority (RDA) ordered the demolition of 38 out of the 40 buildings on its campus, alleging that they were constructed without obtaining mandatory approvals from the competent authorities.
The institution, managed by the Mohammad Ali Jauhar Trust headed by jailed former Uttar Pradesh minister and senior Samajwadi Party leader Azam Khan, has been given 15 days to remove the structures on its own.
Failure to comply within the stipulated period will result in the authorities carrying out demolition in accordance with the law, officials said.
The decision has triggered a fresh political controversy, with the Samajwadi Party accusing the state government of deliberately targeting an educational institution associated with its senior leader.
The demolition directive was issued by Rampur Development Authority Vice-Chairperson and District Magistrate Ajay Kumar Dwivedi under Section 27 of the Uttar Pradesh Urban Planning and Development Act, 1973.
According to Dwivedi, the order was passed after a detailed hearing, careful examination of all available records, and consideration of the relevant statutory provisions.
Officials said the proceedings began after a report submitted by the regional Junior Engineer pointed to alleged violations in the construction of buildings on the university campus.
The report prompted a comprehensive scrutiny of official records by the development authority.
During the verification process, the RDA reportedly found that only two structures—the university’s medical college building and one academic block—had valid building plan approvals.
The remaining 38 buildings, spread across a built-up area of approximately 82,309 square metres, were allegedly constructed without obtaining permission from the competent authority.
Authorities further stated that these buildings stand on land where such usage is not permitted under the prevailing land-use regulations.
Since the violations are not capable of being regularised under existing legal provisions, demolition remains the only legally permissible course of action, officials maintained.
Keeping students’ interests in mind, the District Magistrate has instructed the concerned to ensure that any future demolition process does not adversely affect academic activities.
The Regional Higher Education Officer and the District Inspector of Schools have been asked to establish counselling centres on the campus to guide students and help protect their educational interests during the proceedings.
The action follows notices issued by the Rampur Development Authority on June 28 and June 29 to the Secretary of the Mohammad Ali Jauhar Trust and the University’s Registrar after receiving a complaint regarding the constructions.
Both respondents submitted a joint written reply before the authority on July 8.
Representatives of the university, including its legal counsel and officials, appeared before the authority on Wednesday and presented their arguments during the hearing before the final order was passed.
According to officials, a report submitted by the Additional Chief Officer of the Rampur Zila Panchayat also concluded that approved building plans existed for only two of the 40 structures.
No documentary evidence could be produced to establish that construction approval or sanctioned building plans had ever been obtained for the remaining 38 buildings from any authorised agency.
The order also records that under Section 59 of the Uttar Pradesh Urban Planning and Development Act, 1973, along with other applicable legal provisions, buildings situated in areas that later come under the jurisdiction of a development authority can be treated as lawful only if valid approval had been obtained from the competent authority at the time of construction.
According to the RDA, the Trust failed to furnish any such approvals for the disputed buildings.
In its defence, the university argued that when the buildings were constructed, the land did not fall within the jurisdiction of the Rampur Development Authority.
The authority, however, rejected this contention, observing that approvals from the competent authority were mandatory under the Zila Panchayat Act and other applicable rules even before the area came under the RDA’s control.
The order also referred to various judgments of the Supreme Court dealing with unauthorised constructions, observing that illegal structures cannot be protected and that strict enforcement of planning laws is essential to uphold the rule of law.
Reacting sharply to the development, Samajwadi Party national spokesperson Juhie Singh described Mohammad Ali Jauhar University as an important educational institution where thousands of students receive quality education at affordable fees.
She pointed out that many students are also beneficiaries of government fee reimbursement schemes.
Describing the demolition order as politically motivated, Singh alleged that the action reflected a deliberate campaign against Azam Khan and the institution established under his leadership.
According to her, targeting a major educational institution in this manner raises serious questions about the government’s intentions.
Questioning the government’s stand, the SP leader said that if the absence of approved building plans is the basis for such action, authorities should conduct a similar review of educational institutions linked to legislators and Members of Parliament belonging to the ruling party.
She asserted that action should be taken uniformly wherever violations exist rather than selectively against particular individuals or institutions.
Expressing concern over the future of students, Singh said the proposed demolition would have a direct impact on thousands pursuing higher education at the university.
On the question of further legal action, she expressed confidence that the Mohammad Ali Jauhar Trust would challenge the order before the appropriate judicial forum.

रामपुर स्थित मोहम्मद अली जौहर विश्वविद्यालय के खिलाफ प्रशासन ने बड़ी कार्रवाई करते हुए परिसर की 40 में से 38 इमारतों को ध्वस्त करने का आदेश जारी किया है।
रामपुर विकास प्राधिकरण (आरडीए) का आरोप है कि इन भवनों का निर्माण सक्षम प्राधिकारी से आवश्यक स्वीकृति लिए बिना किया गया।
जेल में बंद पूर्व मंत्री एवं समाजवादी पार्टी के वरिष्ठ नेता आजम खान की अध्यक्षता वाले मोहम्मद अली जौहर ट्रस्ट द्वारा संचालित विश्वविद्यालय को स्वयं इन भवनों को हटाने के लिए 15 दिन का समय दिया गया है।
प्रशासन ने स्पष्ट किया है कि निर्धारित अवधि के भीतर यदि विश्वविद्यालय स्वयं कार्रवाई नहीं करता, तो विकास प्राधिकरण कानून के अनुसार ध्वस्तीकरण की प्रक्रिया शुरू करेगा।
इस आदेश के बाद राजनीतिक विवाद भी तेज हो गया है। समाजवादी पार्टी ने इसे आजम खान और उनके द्वारा स्थापित शिक्षण संस्थान को निशाना बनाने की कार्रवाई करार दिया है।
यह आदेश रामपुर विकास प्राधिकरण के उपाध्यक्ष एवं जिलाधिकारी अजय कुमार द्विवेदी ने उत्तर प्रदेश नगर नियोजन एवं विकास अधिनियम, 1973 की धारा 27 के तहत पारित किया।
जिलाधिकारी ने कहा कि विस्तृत सुनवाई, उपलब्ध अभिलेखों की गहन जांच तथा संबंधित कानूनी प्रावधानों के परीक्षण के बाद यह निर्णय लिया गया है।
अधिकारियों के अनुसार, क्षेत्रीय अवर अभियंता की रिपोर्ट के आधार पर इस मामले में कार्रवाई शुरू की गई थी।
रिपोर्ट में विश्वविद्यालय परिसर में निर्मित भवनों से संबंधित स्वीकृतियों पर गंभीर सवाल उठाए गए थे, जिसके बाद प्राधिकरण ने सभी अभिलेखों की विस्तृत जांच कराई।
रिकॉर्ड के परीक्षण में यह पाया गया कि विश्वविद्यालय के केवल मेडिकल कॉलेज भवन और एक शैक्षणिक ब्लॉक के लिए ही वैध भवन मानचित्र स्वीकृत थे। शेष 38 भवन, जिनका कुल निर्मित क्षेत्रफल लगभग 82,309 वर्ग मीटर है, कथित रूप से सक्षम प्राधिकारी से अनुमति लिए बिना बनाए गए।
प्राधिकरण का यह भी कहना है कि ये भवन ऐसे भू-भाग पर निर्मित हैं, जहां वर्तमान भूमि उपयोग नियमों के अनुसार इस प्रकार का निर्माण अनुमन्य नहीं है।
अधिकारियों के मुताबिक मौजूदा कानून के तहत इन अनियमितताओं का नियमितीकरण संभव नहीं है, इसलिए ध्वस्तीकरण ही एकमात्र वैधानिक विकल्प बचता है।
छात्रों के हितों को ध्यान में रखते हुए जिलाधिकारी ने संबंधित विभागों को निर्देश दिया है कि किसी भी कार्रवाई से विश्वविद्यालय में अध्ययनरत विद्यार्थियों की शिक्षा प्रभावित नहीं होनी चाहिए।
इसके लिए क्षेत्रीय उच्च शिक्षा अधिकारी तथा जिला विद्यालय निरीक्षक को परिसर में परामर्श शिविर स्थापित कर छात्रों को आवश्यक मार्गदर्शन और सहायता उपलब्ध कराने के निर्देश दिए गए हैं।
निर्माण संबंधी शिकायत मिलने के बाद रामपुर विकास प्राधिकरण ने 28 और 29 जून को मोहम्मद अली जौहर ट्रस्ट के सचिव तथा विश्वविद्यालय के कुलसचिव को नोटिस जारी कर अपना पक्ष रखने को कहा था। दोनों पक्षों ने 8 जुलाई को संयुक्त लिखित जवाब प्रस्तुत किया।
बुधवार को विश्वविद्यालय के अधिवक्ता और अधिकारी भी प्राधिकरण के समक्ष उपस्थित हुए तथा अंतिम आदेश से पहले अपना पक्ष विस्तार से रखा।
अधिकारियों के अनुसार, जिला पंचायत रामपुर के अपर मुख्य अधिकारी की रिपोर्ट में भी यही निष्कर्ष सामने आया कि परिसर की 40 इमारतों में केवल दो के लिए ही स्वीकृत भवन मानचित्र उपलब्ध हैं।
शेष 38 भवनों के संबंध में किसी सक्षम प्राधिकारी से निर्माण अनुमति या स्वीकृत मानचित्र प्राप्त होने का कोई अभिलेख प्रस्तुत नहीं किया जा सका।
आदेश में यह भी उल्लेख किया गया है कि उत्तर प्रदेश नगर नियोजन एवं विकास अधिनियम, 1973 की धारा 59 तथा अन्य लागू कानूनी प्रावधानों के अनुसार यदि कोई क्षेत्र बाद में विकास प्राधिकरण के अधिकार क्षेत्र में आता है, तब भी वहां निर्मित भवन तभी वैध माने जाएंगे जब निर्माण के समय सक्षम प्राधिकारी से आवश्यक स्वीकृति प्राप्त की गई हो।
प्राधिकरण ने कहा कि संबंधित ट्रस्ट ऐसे कोई दस्तावेज प्रस्तुत करने में विफल रहा।
विश्वविद्यालय की ओर से दलील दी गई कि भवनों के निर्माण के समय यह भूमि रामपुर विकास प्राधिकरण के अधिकार क्षेत्र में नहीं आती थी।
हालांकि प्राधिकरण ने इस तर्क को स्वीकार नहीं किया और कहा कि उस समय भी जिला पंचायत अधिनियम तथा अन्य लागू नियमों के तहत सक्षम प्राधिकारी से निर्माण स्वीकृति लेना अनिवार्य था।
अपने आदेश में आरडीए ने अनधिकृत निर्माणों पर सुप्रीम कोर्ट के विभिन्न फैसलों का भी उल्लेख किया और कहा कि ऐसे मामलों में कानून का सख्ती से पालन किया जाना आवश्यक है तथा अवैध निर्माणों को संरक्षण नहीं दिया जा सकता।
समाजवादी पार्टी की राष्ट्रीय प्रवक्ता जूही सिंह ने इस कार्रवाई की कड़ी आलोचना करते हुए कहा कि मोहम्मद अली जौहर विश्वविद्यालय प्रदेश का एक महत्वपूर्ण शिक्षण संस्थान है, जहां बड़ी संख्या में छात्र-छात्राएं बेहद कम शुल्क पर उच्च शिक्षा प्राप्त कर रहे हैं।
उन्होंने कहा कि अनेक विद्यार्थियों को शुल्क प्रतिपूर्ति योजना का लाभ भी मिल रहा है।
उन्होंने आरोप लगाया कि इतनी बड़ी शैक्षणिक संस्था को ध्वस्त करने का आदेश आजम खान और उनके द्वारा स्थापित संस्थान के खिलाफ सुनियोजित राजनीतिक अभियान का हिस्सा प्रतीत होता है। उनके अनुसार इस प्रकार की कार्रवाई सरकार की मंशा पर गंभीर सवाल खड़े करती है।
सरकार के तर्क पर सवाल उठाते हुए जूही सिंह ने कहा कि यदि स्वीकृत भवन मानचित्र न होना ही कार्रवाई का आधार है, तो सत्ता पक्ष के विधायकों और सांसदों से जुड़े शिक्षण संस्थानों की भी इसी तरह जांच कराई जानी चाहिए।
उन्होंने कहा कि जहां भी नियमों का उल्लंघन हो, वहां समान रूप से कार्रवाई होनी चाहिए, न कि चुनिंदा व्यक्तियों या संस्थानों को निशाना बनाया जाए।
विद्यार्थियों के भविष्य पर चिंता व्यक्त करते हुए उन्होंने कहा कि प्रस्तावित ध्वस्तीकरण का सीधा असर विश्वविद्यालय में पढ़ रहे हजारों छात्रों की शिक्षा पर पड़ेगा।
ट्रस्ट द्वारा आगे की कानूनी रणनीति के बारे में पूछे जाने पर उन्होंने विश्वास जताया कि संस्था इस आदेश को उचित न्यायिक मंच पर चुनौती देगी और उपलब्ध सभी कानूनी उपायों का सहारा लेगी।
