Sambhal Violence Commission Report: Zia-ur-Rahman Barq Named in Alleged Conspiracy, Police Cleared in 2024 Clash Deaths

The Sambhal Judicial Commission has termed the November 2024 violence a planned conspiracy, naming SP MP Zia-ur-Rahman Barq and others, while concluding that the four deaths were not caused by police firing.

 

The judicial commission constituted to investigate the violence that erupted in Sambhal in November 2024 has concluded that the unrest was the outcome of a carefully coordinated conspiracy rather than an unplanned public reaction.

The three-member panel identified Samajwadi Party (SP) MP Zia-ur-Rahman Barq, Suhel Iqbal, son of SP MLA Iqbal Mehmood, and several office-bearers of the Shahi Jama Masjid management committee among those allegedly responsible for planning the disturbances.

The report, submitted to the Uttar Pradesh government in August last year, was presented in the State Assembly on Wednesday.

The violence took place on November 24, 2024, during protests over a court-directed survey of the 16th-century Shahi Jama Masjid.

Demonstrators clashed with security personnel near the mosque, leaving four people dead and several injured, including 28 police personnel.

Headed by former Allahabad High Court judge Justice Devendra Kumar Arora, the commission concluded that the sequence of events before the violence clearly indicated that the gathering was organised in advance and was not a spontaneous protest.

According to the report, the alleged conspiracy involved MP Zia-ur-Rahman Barq, Suhel Iqbal, Jama Masjid Intezamia Committee president Zafar Ali, advocate Kasim Jamal, advocate Mashhood Ali Farooqui, committee secretary Laddan Khan, the committee’s vice-president and other office-bearers.

The commission stated that these individuals allegedly encouraged and facilitated the events that ultimately resulted in large-scale violence.

The panel further observed that the alleged planning was driven by political considerations as well as an attempt to maintain influence over the management and affairs of the mosque.

Tracing the developments preceding the incident, the commission referred to the first court-directed survey conducted on November 19, 2024.

 

It cited alleged resistance during the survey, public remarks made by MP Barq after Friday prayers on November 22, WhatsApp messages urging people to gather in large numbers for prayers, and telephonic communication between Zafar Ali and the MP on the night before the second survey as circumstances supporting its findings.

The report also examined Sambhal’s history of communal disturbances, stating that repeated episodes of violence had created conditions conducive to religious radicalisation and recurring tensions.

It was observed that the town’s demographic composition, combined with long-standing rivalry between Turk and Pathan groups, had contributed to an atmosphere in which confrontations could easily escalate.

On the issue of the four fatalities, the commission rejected allegations that police firing caused the deaths.

 

Referring to forensic and ballistic evidence, it noted that the gunshot injuries were consistent with .315-bore firearms, whereas there was no evidence that police personnel deployed during the operation were carrying weapons of that calibre.

Based on the available evidence, the panel concluded that the deceased were likely caught in cross-firing allegedly involving miscreants within the crowd, whom it identified as members of local Turk and Pathan groups.

The four deceased were identified as Naeem of Kot Kurvi, Bilal of Sarai Tareen, Numan of Hayat Nagar, and a 19-year-old youth from Sambhal district.

The commission further observed that First Information Reports filed by the relatives of the deceased named unidentified persons and did not specifically accuse police personnel of causing the deaths.

It also noted that similar positions were maintained in statements recorded before the commission.

The report stated that post-mortem examinations confirmed that all four victims died due to firearm injuries.

Ballistic findings submitted during the inquiry suggested that the bullets could have originated from .315-bore weapons.

The commission emphasised that no material on record established possession or use of such weapons by the police contingent deployed at the site.

The inquiry additionally recorded that seven police personnel sustained bullet injuries allegedly fired by individuals present in the crowd.

The report documented extensive violence during the clashes, including stone-pelting, firing, arson, attacks on police personnel, damage to government and private vehicles, and allegations that police ammunition was forcibly snatched during the confrontation.

After examining eyewitness accounts, forensic material and other documentary evidence, the commission concluded that the Sambhal violence posed a serious challenge to national security and could attract stringent provisions of the Bharatiya Nyaya Sanhita if the allegations were established through the judicial process.

According to the report, the scale of destruction and coordinated nature of the violence appeared intended to disrupt public order, threaten India’s unity, sovereignty and security, and spread fear among citizens.

It observed that offences of such gravity, if proved before a court, could invite severe punishment, including life imprisonment.

The commission largely endorsed the preparedness of the district administration and police for the court-ordered survey.

It noted that prohibitory orders had already been imposed, peace committee meetings were organised, repeated public appeals were issued against rumours and unlawful assemblies, CCTV surveillance was reviewed, additional police forces were deployed and barricading was carried out at vulnerable locations.

The panel also referred to evidence recovered after the violence.

During post-riot searches, investigators, assisted by Local Intelligence Unit personnel and forensic teams, recovered a foreign-made 12-bore cartridge bearing the marking “Made in USA” from a nearby drain after it was cleaned using a hand-held metal detector.

The recovery was officially documented through a seizure memo.

The legal dispute over the Shahi Jama Masjid began on November 19, 2024, when Hindu petitioners approached the Sambhal district court, claiming that the mosque had been constructed on the site of an ancient temple in the 16th century.

Following the court’s direction, a survey of the mosque was conducted on the same day.

A second survey on November 24 triggered widespread unrest that resulted in four deaths and injuries to 29 police personnel.

The civil suit was filed by eight petitioners, including advocate Hari Shankar Jain, who is also associated with the Gyanvapi-Kashi Vishwanath litigation, advocate Parth Yadav, Mahant Rishiraj Giri of Kalki Devi Temple, Ved Pal Singh of Noida, and Sambhal residents Rakesh Kumar, Jitpal Yadav, Madanpal and Deenanath.

In their petition, the applicants claimed that an ancient Shri Hari Har Temple dedicated to Lord Kalki existed at the disputed site and alleged that the property was being unlawfully occupied and used by the Jama Masjid Committee.

संभल हिंसा जांच आयोग की रिपोर्ट: जिया-उर-रहमान बर्क समेत कई लोगों पर साजिश का आरोप, पुलिस को मिली क्लीन चिट

नवंबर 2024 में संभल में हुई हिंसा की जांच के लिए गठित न्यायिक आयोग ने अपनी रिपोर्ट में कहा है कि यह घटना अचानक भड़की भीड़ का परिणाम नहीं थी, बल्कि पहले से बनाई गई सुनियोजित रणनीति का हिस्सा थी।

तीन सदस्यीय आयोग ने समाजवादी पार्टी के सांसद जिया-उर-रहमान बर्क, सपा विधायक इकबाल महमूद के पुत्र सुहेल इकबाल तथा शाही जामा मस्जिद इंतेजामिया कमेटी के कई पदाधिकारियों को कथित साजिशकर्ताओं में शामिल बताया है।

आयोग की रिपोर्ट पिछले वर्ष अगस्त में राज्य सरकार को सौंप दी गई थी, जिसे बुधवार को उत्तर प्रदेश विधानसभा में पेश किया गया।

24 नवंबर 2024 को अदालत के आदेश पर शाही जामा मस्जिद के सर्वेक्षण के दौरान विरोध प्रदर्शन हिंसक हो गया था।

प्रदर्शनकारियों और पुलिस के बीच हुई झड़प में चार लोगों की मौत हो गई थी, जबकि 28 पुलिसकर्मियों सहित कई अन्य घायल हुए थे।

पूर्व इलाहाबाद हाईकोर्ट न्यायाधीश न्यायमूर्ति देवेंद्र कुमार अरोड़ा की अध्यक्षता वाले आयोग ने कहा कि हिंसा से पहले की घटनाओं का क्रम स्पष्ट रूप से संकेत देता है कि 24 नवंबर की भीड़ स्वतः एकत्र नहीं हुई थी, बल्कि इसकी पहले से तैयारी की गई थी।

रिपोर्ट के अनुसार कथित षड्यंत्र में सांसद जिया-उर-रहमान बर्क, सुहेल इकबाल, शाही जामा मस्जिद इंतेजामिया कमेटी के अध्यक्ष जफर अली, अधिवक्ता कासिम जमाल, अधिवक्ता मशहूद अली फारूकी, कमेटी के सचिव लद्दन खान, नायब सदर तथा अन्य पदाधिकारी शामिल थे।

आयोग का कहना है कि इन लोगों ने कथित रूप से ऐसी गतिविधियों को बढ़ावा दिया, जिनके परिणामस्वरूप हिंसा भड़की।

आयोग ने यह भी कहा कि कथित योजना के पीछे राजनीतिक प्रभाव बनाए रखने और मस्जिद के प्रबंधन पर नियंत्रण कायम रखने की मंशा भी एक प्रमुख कारण प्रतीत होती है।

रिपोर्ट में 19 नवंबर 2024 को हुए पहले न्यायालय-निर्देशित सर्वेक्षण से लेकर 24 नवंबर की घटना तक की पूरी घटनाक्रम का उल्लेख किया गया है।

इसमें सर्वेक्षण के दौरान कथित बाधा, 22 नवंबर की जुमे की नमाज के बाद सांसद बर्क के बयान, बड़ी संख्या में लोगों को नमाज के लिए बुलाने वाले व्हाट्सएप संदेश तथा दूसरे सर्वेक्षण से एक रात पहले जफर अली और सांसद के बीच हुई कथित टेलीफोन वार्ता को महत्वपूर्ण परिस्थितिजन्य साक्ष्य बताया गया है।

आयोग ने संभल के सांप्रदायिक इतिहास का भी उल्लेख करते हुए कहा कि लंबे समय से समय-समय पर हुई हिंसक घटनाओं ने धार्मिक कट्टरता और तनाव के लिए अनुकूल वातावरण तैयार किया।

रिपोर्ट में यह भी कहा गया कि तुर्क और पठान समुदायों के बीच प्रभुत्व की प्रतिस्पर्धा ने भी स्थानीय परिस्थितियों को और संवेदनशील बनाया।

चार लोगों की मौत के संबंध में आयोग ने पुलिस फायरिंग के आरोपों को स्वीकार नहीं किया।

फोरेंसिक और बैलिस्टिक साक्ष्यों के आधार पर आयोग ने कहा कि मृतकों को लगी गोलियां .315 बोर हथियारों से चलने की संभावना है, जबकि घटनास्थल पर तैनात पुलिसकर्मियों के पास ऐसे हथियार होने का कोई प्रमाण नहीं मिला।

आयोग के अनुसार उपलब्ध साक्ष्यों से यह संभावना सामने आती है कि मृतकों की जान भीड़ में मौजूद उपद्रवियों के बीच हुई क्रॉस फायरिंग में गई।

रिपोर्ट में इन उपद्रवियों को स्थानीय तुर्क और पठान समूहों से संबंधित बताया गया है।

मृतकों की पहचान कोट कुर्वी निवासी नईम, सराय तरीन निवासी बिलाल, हयात नगर निवासी नुमान तथा 19 वर्षीय एक युवक के रूप में की गई है।

रिपोर्ट में यह भी दर्ज है कि मृतकों के परिजनों द्वारा दर्ज कराई गई एफआईआर में अज्ञात व्यक्तियों का उल्लेख किया गया था और किसी भी शिकायत या आयोग के समक्ष दिए गए बयान में पुलिस पर हत्या का आरोप नहीं लगाया गया।

पोस्टमार्टम करने वाले चिकित्सकों की राय का हवाला देते हुए आयोग ने कहा कि सभी की मृत्यु गोली लगने से हुई।

बैलिस्टिक रिपोर्ट में भी .315 बोर हथियारों की संभावना जताई गई, जबकि पुलिस के पास ऐसे हथियार होने का कोई साक्ष्य जांच में सामने नहीं आया।

जांच के दौरान यह भी पाया गया कि भीड़ की ओर से हुई गोलीबारी में सात पुलिसकर्मी घायल हुए थे।

रिपोर्ट में पथराव, गोलीबारी, आगजनी, सरकारी और निजी वाहनों को नुकसान पहुंचाने, पुलिसकर्मियों पर हमले तथा पुलिस का गोला-बारूद छीनने की कथित घटनाओं का भी विस्तृत उल्लेख किया गया है।

प्रत्यक्षदर्शियों के बयान, फोरेंसिक रिपोर्ट और अन्य दस्तावेजी साक्ष्यों का परीक्षण करने के बाद आयोग ने निष्कर्ष निकाला कि संभल हिंसा राष्ट्रीय सुरक्षा के लिए गंभीर चुनौती थी और यदि आरोप न्यायिक प्रक्रिया में सिद्ध होते हैं तो भारतीय न्याय संहिता के कठोर प्रावधान लागू हो सकते हैं।

रिपोर्ट के अनुसार हिंसा का स्वरूप, व्यापक नुकसान और कथित समन्वित कार्रवाई का उद्देश्य देश की एकता, अखंडता, संप्रभुता और सुरक्षा को प्रभावित करना तथा आम नागरिकों में भय का वातावरण उत्पन्न करना प्रतीत होता है।

आयोग ने कहा कि ऐसे अपराध यदि अदालत में सिद्ध होते हैं तो आजीवन कारावास जैसी कठोर सजा भी संभव है।

जांच आयोग ने जिला प्रशासन और पुलिस की तैयारियों को पर्याप्त माना।

रिपोर्ट में कहा गया कि पहले से निषेधाज्ञा लागू थी, शांति समिति की बैठकें आयोजित की गई थीं, अफवाहों और अवैध जमावड़े के विरुद्ध सार्वजनिक अपीलें जारी की गई थीं, सीसीटीवी व्यवस्था की समीक्षा की गई थी, अतिरिक्त पुलिस बल तैनात किया गया था तथा संवेदनशील स्थानों पर बैरिकेडिंग की गई थी।

हिंसा के बाद एकत्र किए गए साक्ष्यों का उल्लेख करते हुए आयोग ने बताया कि स्थानीय खुफिया इकाई और फोरेंसिक टीम की मौजूदगी में नालों की तलाशी के दौरान हैंड हेल्ड मेटल डिटेक्टर की सहायता से “Made in USA” अंकित विदेशी 12 बोर कारतूस बरामद किया गया, जिसकी विधिवत जब्ती पंचनामा तैयार किया गया।

शाही जामा मस्जिद विवाद की शुरुआत 19 नवंबर 2024 को हुई थी, जब हिंदू पक्षकारों ने संभल जिला न्यायालय में दावा किया कि 16वीं शताब्दी में मस्जिद का निर्माण एक प्राचीन मंदिर के ऊपर किया गया था।

अदालत के आदेश पर उसी दिन पहला सर्वेक्षण कराया गया। इसके बाद 24 नवंबर को हुए दूसरे सर्वेक्षण के दौरान क्षेत्र में हिंसा भड़क गई, जिसमें चार लोगों की जान गई और 29 पुलिसकर्मी घायल हुए।

यह वाद आठ याचिकाकर्ताओं ने दायर किया था, जिनमें अधिवक्ता हरिशंकर जैन, अधिवक्ता पार्थ यादव, कल्कि देवी मंदिर के महंत ऋषिराज गिरि, नोएडा निवासी वेदपाल सिंह तथा संभल निवासी राकेश कुमार, जीतपाल यादव, मदनपाल और दीनानाथ शामिल हैं।

याचिका में दावा किया गया है कि विवादित परिसर में भगवान कल्कि को समर्पित प्राचीन श्री हरिहर मंदिर स्थित है और उस स्थान का उपयोग जामा मस्जिद समिति द्वारा कथित रूप से अवैध रूप से किया जा रहा है।
