Supreme Court Reopens Scrutiny of 22 Sohrabuddin Case Acquittals, Declines to Revisit Amit Shah Discharge
CJI Surya Kant-led bench seeks key witness statements after concerns over 92 hostile witnesses; next hearing scheduled for October 28
New Delhi, September 29, 2026: The Supreme Court has decided to take a closer look at the acquittal of 22 accused in the long-running Sohrabuddin Shaikh encounter case, but has drawn a clear line around an earlier judicial decision that discharged Union Home Minister Amit Shah from the proceedings.
A three-judge bench headed by Chief Justice of India Surya Kant, along with Justices Joymalya Bagchi and V Mohana, on Monday issued notice on an appeal filed by Rubabuddin Shaikh, the younger brother of Sohrabuddin.
The appeal challenges the Bombay High Court’s May 7, 2026 decision upholding the acquittal of all 22 accused in the case.
The court’s decision does not amount to a finding of guilt against any of those acquitted. Instead, the bench has agreed to examine whether there are sufficient grounds to scrutinise the concurrent acquittal findings, particularly in light of questions surrounding the prosecution evidence and the conduct of the trial.
One issue that immediately drew the bench’s attention was the unusually large number of prosecution witnesses who did not support the case during trial.
The Bombay High Court’s judgment records that 92 of the 210 witnesses examined by the prosecution turned hostile.
The High Court nevertheless concluded that the prosecution had failed to establish the charges against the accused.
Senior advocate D S Naidu, appearing for Rubabuddin, told the Supreme Court that the case could not be assessed solely based on witnesses who had changed their positions.
He pointed to forensic material, including bullet injuries and recovered cartridges, and also raised the unresolved circumstances surrounding Kausar Bi.
Justice Bagchi indicated that the large number of hostile witnesses itself was a matter of concern. The court, however, did not say that the acquittals should be overturned.
Instead, Chief Justice Surya Kant adopted a focused approach. Rather than calling for the entire record, he asked the appellant’s counsel to identify four or five witness statements considered particularly significant.
The bench said it would examine those statements before proceeding further.
Amit Shah’s discharge remains outside the review.
The Supreme Court simultaneously made clear that it would not reopen the issue of Amit Shah’s discharge.
Shah was discharged by the trial court in December 2014. An application subsequently sought to challenge that decision, but the Bombay High Court rejected the attempt.
The High Court noted that earlier challenges to Shah’s discharge had already been rejected by both the High Court and the Supreme Court and questioned the circumstances in which the fresh application had been brought.
During Monday’s hearing, Justice Bagchi told the appellant’s counsel that this part of the matter was already closed. Chief Justice Surya Kant also indicated that the relevant paragraph of the High Court judgment would not be reopened.
The distinction is therefore significant: the Supreme Court has agreed to examine the acquittals of the 22 people who stood trial, but it has not reopened Shah’s discharge.
Case dates back to 2005
The case originates in the death of Sohrabuddin Shaikh in November 2005, followed by the killing of his wife Kausar Bi and, later, the death of his associate Tulsiram Prajapati in what the prosecution had alleged were staged encounters.
Following concerns raised about the initial investigation, the Supreme Court ordered further investigation by the CBI in 2010. The proceedings were subsequently shifted from Gujarat to Mumbai. T
Bombay High Court judgment records that the CBI eventually filed chargesheets against 38 people, although several accused were discharged during the course of the proceedings, and three others had their charges dropped.
The trial court ultimately acquitted the 22 accused who remained before it. Their acquittal was challenged by Sohrabuddin’s brothers, Rubabuddin and Nayamuddin Shaikh.
In May this year, the Bombay High Court upheld the trial court’s verdict. The bench held that the prosecution had failed to establish the alleged criminal conspiracy and emphasised the legal presumption of innocence that becomes stronger after an acquittal.
High Court had cited weakness in prosecution evidence
The Bombay High Court’s judgment noted that the prosecution case rested substantially on circumstantial evidence.
It observed that numerous witnesses did not support the prosecution and that the evidence ultimately failed to establish the involvement of the accused beyond the required legal threshold.
The High Court also pointed out that several accused had already been discharged based on the same broad body of evidence.
It held that those earlier decisions had become final and affected the foundation of the prosecution’s conspiracy theory.
The Supreme Court’s latest intervention now brings the acquittal question back into judicial scrutiny, although the bench has not indicated that it has reached any conclusion on the merits.
Police officers seek early resolution.
Counsel representing some of the acquitted police officers urged the Supreme Court not to allow the matter to remain unresolved indefinitely.
Senior advocate K Parameshwar, appearing for some of the police personnel, told the bench that the accused were public servants who had lived with the case for about 12 years. He sought an early hearing.
The Supreme Court has consequently narrowed the immediate examination to selected witness statements rather than ordering a wholesale reopening of the case record.
The next stage will determine whether the material identified by Rubabuddin’s lawyers is sufficient to persuade the court to undertake a deeper examination of the acquittals.
For now, the order leaves two distinct legal tracks: the 22 acquittals remain open for Supreme Court scrutiny, while the earlier decision discharging Amit Shah remains undisturbed.

नई दिल्ली, 29 सितंबर 2026: सुप्रीम कोर्ट ने लंबे समय से चले आ रहे सोहराबुद्दीन शेख कथित फर्जी मुठभेड़ मामले में 22 आरोपियों को बरी किए जाने के फैसले की जांच करने पर सहमति जताई है। हालांकि, अदालत ने केंद्रीय गृह मंत्री अमित शाह को मामले से आरोपमुक्त किए जाने के पुराने फैसले को दोबारा खोलने से साफ इनकार कर दिया।
मुख्य न्यायाधीश सूर्यकांत की अध्यक्षता वाली तीन सदस्यीय पीठ ने सोमवार को सोहराबुद्दीन के छोटे भाई रुबाबुद्दीन शेख की अपील पर नोटिस जारी किया। पीठ में न्यायमूर्ति जॉयमाल्या बागची और न्यायमूर्ति वी. मोहना भी शामिल हैं।
अपील में 7 मई 2026 को दिए गए बॉम्बे हाईकोर्ट के उस फैसले को चुनौती दी गई है, जिसमें 22 आरोपियों की बरी को बरकरार रखा गया था।
सुप्रीम कोर्ट का यह कदम आरोपियों को दोषी ठहराने का निष्कर्ष नहीं है। अदालत फिलहाल यह देखना चाहती है कि क्या उपलब्ध सामग्री के आधार पर हाईकोर्ट और निचली अदालत द्वारा दिए गए बरी किए जाने के फैसलों की दोबारा न्यायिक जांच की जरूरत बनती है।
सुनवाई के दौरान सबसे महत्वपूर्ण मुद्दों में से एक गवाहों के बड़ी संख्या में अपने पहले के बयानों से पीछे हटने का रहा।
बॉम्बे हाईकोर्ट के फैसले के मुताबिक अभियोजन पक्ष ने कुल 210 गवाह पेश किए थे, जिनमें से 92 गवाहों ने अदालत में अभियोजन के पक्ष का समर्थन नहीं किया। इसके बावजूद हाईकोर्ट ने माना था कि अभियोजन आरोप साबित करने में सफल नहीं हुआ।
रुबाबुद्दीन की ओर से पेश वरिष्ठ अधिवक्ता डी.एस. नायडू ने सुप्रीम कोर्ट में दलील दी कि मामले का आकलन केवल उन गवाहों के आधार पर नहीं किया जा सकता, जो बाद में अपने रुख से पीछे हट गए।
उन्होंने फोरेंसिक सामग्री, गोली लगने से जुड़ी परिस्थितियों और बरामद कारतूसों का उल्लेख किया। उन्होंने कासौर बी के मामले में भी कई सवालों की ओर अदालत का ध्यान खींचा।
न्यायमूर्ति बागची ने इस बात को गंभीर माना कि मुकदमे में इतने बड़ी संख्या में गवाह अभियोजन के पक्ष में नहीं रहे। हालांकि, अदालत ने यह नहीं कहा कि आरोपियों की बरी को पलटा जाना चाहिए।
इसके बजाय मुख्य न्यायाधीश सूर्यकांत ने मामले की सीमित और केंद्रित जांच का रास्ता चुना। उन्होंने पूरी रिकॉर्ड फाइल मंगाने के बजाय अपीलकर्ता के वकील से ऐसे चार-पांच महत्वपूर्ण गवाहों के बयान देने को कहा, जिनके आधार पर वह अदालत को आगे विचार करने के लिए राजी करना चाहते हैं।
अमित शाह को आरोपमुक्त करने का फैसला नहीं खुलेगा
सुप्रीम कोर्ट ने साथ ही स्पष्ट कर दिया कि अमित शाह को मामले से आरोपमुक्त किए जाने के फैसले को दोबारा नहीं खोला जाएगा।
शाह को दिसंबर 2014 में ट्रायल कोर्ट ने मामले से आरोपमुक्त कर दिया था। बाद में इस आदेश को चुनौती देने का प्रयास किया गया, लेकिन बॉम्बे हाईकोर्ट ने उस आवेदन को खारिज कर दिया था।
हाईकोर्ट ने अपने फैसले में यह भी दर्ज किया कि शाह की आरोपमुक्ति के खिलाफ पहले हाईकोर्ट और सुप्रीम कोर्ट में की गई चुनौतियां खारिज हो चुकी थीं।
सोमवार की सुनवाई में न्यायमूर्ति बागची ने स्पष्ट किया कि यह मुद्दा अब बंद हो चुका है। मुख्य न्यायाधीश सूर्यकांत ने भी संकेत दिया कि हाईकोर्ट के फैसले के संबंधित हिस्से को दोबारा खोलने की अनुमति नहीं दी जाएगी।
इस प्रकार मामले में दो अलग-अलग कानूनी स्थितियां बन गई हैं—22 आरोपियों की बरी की समीक्षा का रास्ता खुला है, जबकि अमित शाह की पुरानी आरोपमुक्ति पर दोबारा सुनवाई नहीं होगी।
2005 में शुरू हुआ था मामला
इस मामले की शुरुआत नवंबर 2005 में सोहराबुद्दीन शेख की मौत से हुई थी। इसके बाद उनकी पत्नी कासौर बी और उनके सहयोगी तुलसीराम प्रजापति की मौत हुई। अभियोजन पक्ष ने इन घटनाओं को कथित फर्जी मुठभेड़ से जोड़ते हुए आपराधिक साजिश का आरोप लगाया था।
जांच को लेकर उठे सवालों के बाद सुप्रीम कोर्ट ने 2010 में आगे की जांच CBI को सौंपने का आदेश दिया। बाद में मामले की सुनवाई गुजरात से मुंबई स्थानांतरित कर दी गई। बॉम्बे हाईकोर्ट के रिकॉर्ड के अनुसार CBI ने कुल 38 लोगों के खिलाफ आरोपपत्र दाखिल किया था।
मुकदमे के दौरान कई आरोपियों को अलग-अलग आदेशों के जरिए आरोपमुक्त किया गया, जबकि कुछ के खिलाफ आरोप समाप्त कर दिए गए।
अंततः ट्रायल कोर्ट के सामने बचे 22 आरोपियों को बरी कर दिया गया। इसके खिलाफ सोहराबुद्दीन के भाइयों रुबाबुद्दीन और नयामुद्दीन शेख ने बॉम्बे हाईकोर्ट का रुख किया।
मई 2026 में बॉम्बे हाईकोर्ट ने निचली अदालत के फैसले को बरकरार रखा। हाईकोर्ट ने कहा कि अभियोजन पक्ष कथित आपराधिक साजिश और आरोपियों की भूमिका को आवश्यक कानूनी स्तर तक साबित नहीं कर सका।
अदालत ने यह भी कहा कि बरी किए जाने के बाद आरोपियों के पक्ष में मौजूद निर्दोषता की धारणा और मजबूत हो जाती है।
हाईकोर्ट ने अभियोजन के सबूतों पर उठाए थे सवाल
बॉम्बे हाईकोर्ट ने अपने फैसले में कहा था कि अभियोजन का मामला काफी हद तक परिस्थितिजन्य साक्ष्यों पर आधारित था। अदालत ने गवाहों के अपने बयानों से पीछे हटने और अभियोजन द्वारा आरोपों को पर्याप्त स्तर तक साबित नहीं कर पाने को फैसले में महत्वपूर्ण माना।
कई आरोपियों को पहले ही उसी व्यापक साक्ष्य के आधार पर आरोपमुक्त किया जा चुका था। अदालत के अनुसार, उन फैसलों के अंतिम रूप ले लेने से अभियोजन की आपराधिक साजिश वाली पूरी थ्योरी पर भी असर पड़ा था।
अब सुप्रीम कोर्ट ने बरी किए गए 22 आरोपियों के मामले को एक बार फिर न्यायिक जांच के दायरे में ला दिया है। हालांकि, अदालत ने अभी तक यह संकेत नहीं दिया है कि वह बरी किए जाने के फैसले को गलत मानती है।
पुलिसकर्मियों ने जल्द सुनवाई की मांग की
कुछ बरी किए गए पुलिस अधिकारियों की ओर से पेश वरिष्ठ अधिवक्ता के. परमेश्वर ने मामले को जल्द निपटाने का अनुरोध किया।
उन्होंने अदालत से कहा कि संबंधित पुलिसकर्मी सरकारी कर्मचारी हैं और लगभग 12 वर्षों से इस मामले का बोझ झेल रहे हैं। इसलिए अपील की सुनवाई में अनावश्यक देरी नहीं होनी चाहिए।
सुप्रीम कोर्ट ने फिलहाल पूरे मामले की फाइल दोबारा खोलने के बजाय उन चुनिंदा गवाहों के बयानों पर ध्यान केंद्रित किया है जिन्हें अपीलकर्ता पक्ष सबसे महत्वपूर्ण मानता है।
अब अगली सुनवाई में यह स्पष्ट होगा कि इन गवाहों के बयान और अन्य सामग्री सुप्रीम कोर्ट को बरी किए गए आरोपियों के मामले में विस्तृत हस्तक्षेप के लिए पर्याप्त आधार देते हैं या नहीं।
फिलहाल सुप्रीम कोर्ट का आदेश दो स्पष्ट कानूनी रास्ते तय करता है—22 आरोपियों की बरी के खिलाफ अपील पर अदालत आगे विचार करेगी, लेकिन अमित शाह को 2014 में आरोपमुक्त किए जाने का फैसला दोबारा नहीं खोला जाएगा।
