2020 Delhi Riots: Tahir Hussain Awarded Life Imprisonment for Ankit Sharma Murder, Court Rejects Death Penalty
More than six years after Intelligence Bureau employee Ankit Sharma was brutally killed during the 2020 northeast Delhi communal riots, a Delhi court on Friday sentenced former Aam Aadmi Party councillor Tahir Hussain to life imprisonment, holding him guilty of his role in the murder.
The prosecution had pressed for capital punishment, describing the offence as one of exceptional brutality.
Pronouncing the sentence, Additional Sessions Judge Praveen Singh observed that the killing was marked by extreme cruelty and took place against the backdrop of communal unrest.
The court noted that the victim’s body was allegedly dragged and discarded into a drain in a manner that reflected complete disregard for human dignity.
While several convicts pleaded for leniency on the ground that they were the sole earning members of their families, the court held that the gravity of the offence far outweighed those considerations.
Even while imposing life imprisonment, the court declined to award the death sentence.
It pointed out that the prosecution had failed to place material on record indicating that the convicts possessed an inherent tendency towards violent criminal behaviour.
Observing that capital punishment must remain an exceptional remedy reserved for the rarest circumstances, the court concluded that the convicts were capable of reform and could be rehabilitated within the prison system.
During the sentencing arguments earlier this week, Delhi Police, represented by Special Public Prosecutor Madhukar Pandey, urged the court to impose the death penalty on all the convicted persons.
Opposing the plea, Tahir Hussain’s legal team argued that the present matter did not satisfy the legal threshold for awarding capital punishment.
The defence also highlighted Hussain’s satisfactory conduct during incarceration and maintained that the number of injuries suffered by the victim alone could not justify a death sentence.
Appearing for the defence, advocates Rajiv Mohan, Narula, Sonal Sarda and Shivangi Sharma further contended that throughout the trial the prosecution had failed to establish any criminal conspiracy.
They also argued that the widespread violence had spiralled beyond the control of the police, making it impossible to attribute the larger disturbance to any planned conspiracy involving their client.
Following the sentencing order, the defence announced its decision to challenge the verdict before the Delhi High Court.
Earlier this month, the trial court had convicted Tahir Hussain along with several other accused in connection with the killing.
Hussain was held guilty of offences including murder and rioting, though he was acquitted of the charge of criminal conspiracy.
The case relates to the events of February 25, 2020, when 26-year-old Intelligence Bureau employee Ankit Sharma left his residence in the Chand Bagh area to purchase groceries but never returned home.
According to the prosecution, he was allegedly intercepted by a violent mob, assaulted and later killed before his body was thrown into a nearby drain. Investigators claimed that Sharma had suffered 51 stab injuries.
Ankit Sharma was among the 53 people who lost their lives during the communal violence that engulfed parts of northeast Delhi in February 2020.
The criminal investigation formally began on February 26, 2020, after Sharma’s father, Ravinder Kumar, lodged a complaint with the police.
In his statement, he accused Tahir Hussain and alleged that the assailants had operated from a building linked to the former councillor while carrying out the fatal attack.

उत्तर-पूर्वी दिल्ली में वर्ष 2020 के सांप्रदायिक दंगों के दौरान खुफिया ब्यूरो (आईबी) के कर्मचारी अंकित शर्मा की हत्या के मामले में दिल्ली की एक अदालत ने शुक्रवार को पूर्व आम आदमी पार्टी पार्षद ताहिर हुसैन को आजीवन कारावास की सजा सुनाई।
अभियोजन पक्ष ने इस मामले में मृत्युदंड की मांग करते हुए अपराध को अत्यंत जघन्य करार दिया था, लेकिन अदालत ने इसे स्वीकार नहीं किया।
अतिरिक्त सत्र न्यायाधीश प्रवीण सिंह ने सजा सुनाते हुए कहा कि हत्या अत्यधिक निर्ममता के साथ सांप्रदायिक हिंसा के दौरान अंजाम दी गई।
अदालत ने टिप्पणी की कि पीड़ित के शव के साथ अमानवीय व्यवहार किया गया और उसे घसीटकर नाले में फेंक दिया गया।
न्यायालय ने यह भी कहा कि यद्यपि दोषियों ने स्वयं को परिवार का एकमात्र कमाने वाला सदस्य बताते हुए नरमी की अपील की, लेकिन अपराध की भयावहता इन दलीलों पर भारी पड़ती है।
हालांकि अदालत ने मृत्युदंड देने से इनकार करते हुए कहा कि अभियोजन पक्ष ऐसा कोई ठोस साक्ष्य प्रस्तुत नहीं कर सका जिससे यह साबित हो कि दोषियों में स्वभावगत हिंसक प्रवृत्ति या लगातार गंभीर अपराध करने की प्रवृत्ति थी।
न्यायालय ने कहा कि फांसी की सजा केवल अत्यंत दुर्लभ मामलों में ही दी जानी चाहिए और वर्तमान मामले में दोषियों के सुधार की संभावना से इनकार नहीं किया जा सकता।
सजा पर बहस के दौरान दिल्ली पुलिस की ओर से विशेष लोक अभियोजक मधुकर पांडेय ने सभी दोषियों को मृत्युदंड दिए जाने की मांग की थी।
इसके विपरीत ताहिर हुसैन की ओर से पेश अधिवक्ताओं ने दलील दी कि यह मामला उन विरल परिस्थितियों की श्रेणी में नहीं आता, जहां फांसी की सजा उचित मानी जाए।
बचाव पक्ष ने जेल में हुसैन के अच्छे आचरण का भी उल्लेख करते हुए कहा कि केवल चोटों की संख्या के आधार पर किसी व्यक्ति को मृत्युदंड नहीं दिया जा सकता।
बचाव पक्ष की ओर से अधिवक्ता राजीव मोहन, नरूला, सोनल सरदा और शिवांगी शर्मा ने अदालत को बताया कि पूरे मुकदमे के दौरान अभियोजन पक्ष किसी आपराधिक षड्यंत्र को प्रमाणित नहीं कर सका।
उन्होंने यह भी तर्क दिया कि उस समय फैली हिंसा पर पुलिस स्वयं नियंत्रण स्थापित करने में असफल रही थी, इसलिए व्यापक दंगों का दायित्व उनके मुवक्किल पर नहीं डाला जा सकता।
सजा सुनाए जाने के तुरंत बाद बचाव पक्ष ने स्पष्ट किया कि वह इस फैसले को चुनौती देने के लिए दिल्ली हाईकोर्ट का दरवाजा खटखटाएगा।
इससे पहले इसी महीने अदालत ने ताहिर हुसैन सहित कई आरोपियों को इस मामले में दोषी ठहराया था।
न्यायालय ने हुसैन को हत्या, दंगा और अन्य अपराधों में दोषसिद्ध किया, जबकि आपराधिक षड्यंत्र के आरोप से उन्हें बरी कर दिया गया।
यह मामला 25 फरवरी 2020 की घटना से जुड़ा है, जब 26 वर्षीय आईबी कर्मचारी अंकित शर्मा अपने घर से चांदबाग इलाके में किराना सामान लेने निकले थे, लेकिन वापस नहीं लौटे।
अभियोजन के अनुसार उन्हें एक उग्र भीड़ ने घेर लिया, उनकी हत्या कर दी और बाद में शव को नाले में फेंक दिया। पुलिस का दावा है कि उनके शरीर पर चाकू के 51 घाव पाए गए थे।
फरवरी 2020 में उत्तर-पूर्वी दिल्ली में भड़की सांप्रदायिक हिंसा में जान गंवाने वाले 53 लोगों में अंकित शर्मा भी शामिल थे।
घटना के अगले दिन, 26 फरवरी 2020 को अंकित शर्मा के पिता रविंदर कुमार की शिकायत पर पुलिस ने मामला दर्ज किया। अपनी शिकायत में उन्होंने ताहिर हुसैन को नामजद करते हुए आरोप लगाया था कि उनके भवन से संचालित दंगाइयों ने इस जानलेवा हमले को अंजाम दिया।
