Allahabad High Court Orders Probe into Ballia Policeman’s Alleged Business Activities, Questions Commercialisation of Police Stations

 Prayagraj: Raising serious concerns over the alleged involvement of police personnel in private business ventures, the Allahabad High Court has remarked that some police stations appear to be functioning as centres of commercial activity instead of focusing on their primary responsibility of maintaining law and order.

The court observed that such a trend, if allowed to continue, could seriously undermine policing in the state.

Hearing the matter, Justice Rohit Ranjan Agarwal directed the Director General of Police (DGP), Uttar Pradesh, to conduct a detailed inquiry into allegations that a police constable posted in Ballia district was engaged in the transport business while serving in the police force.

Apart from ordering the inquiry, the Bench instructed the DGP as well as the Additional Chief Secretary (Home), Uttar Pradesh, to initiate disciplinary proceedings against all police officers and constables posted at Rasra Police Station in Ballia district.

The High Court also directed the DGP to submit a personal affidavit within ten days, placing on record the action taken in compliance with the court’s directions.

These observations came during the hearing of a petition filed by Harendra Yadav, who challenged the decision of the Assistant Regional Transport Officer (ARTO), Ballia, to blacklist his truck.

According to the records placed before the court, the vehicle was blacklisted based on a report submitted by a sub-inspector over an ownership dispute between the petitioner and Santosh Kumar, a police constable posted at Rasra Police Station.

During the proceedings, the court directly questioned the constable. He informed the Bench that he had withdrawn money from his General Provident Fund (GPF) account and entered into a business arrangement with the petitioner in the name of his brother.

He further stated that a truck had been purchased under that arrangement and was being operated by the petitioner.

After examining the record, the court found that the ARTO had ordered the blacklisting of the vehicle solely based on the report submitted by Sub-Inspector Shiv Murti Tiwari regarding the ownership dispute, without any independent assessment of the matter.

The Bench also noted that the affidavit filed by the Superintendent of Police, Ballia, contained no indication that any departmental action had been initiated against the constable despite allegations that he was carrying on a transport business while being posted at a police station.

Expressing strong displeasure over the situation, the court observed that it was deeply disturbed by the fact that police stations appeared to have turned into places where commercial interests were being pursued.

It remarked that if police personnel remained occupied with business activities instead of policing, effective maintenance of law and order would become impossible.

The court further observed that the officer in charge of Rasra Police Station and the Superintendent of Police, Ballia, appeared to have shielded the constable by forwarding a favourable report to the ARTO.

Acting on that report, the transport authority blacklisted the truck and restrained its transfer.

Taking an overall view of the material available on record, the Bench remarked that the affidavits submitted by various authorities created an impression that commercial activities had permeated the functioning of the entire police station concerned.

In view of these circumstances, the High Court, through its order dated July 27, instructed the DGP to conduct a comprehensive inquiry into the alleged commercial dealings associated with Rasra Police Station.

Simultaneously, it ordered the initiation of disciplinary proceedings against every police officer and constable posted there.

The matter has now been listed for further hearing before the court on August 11, when the authorities are expected to place the outcome of the inquiry and the action taken report on record.

प्रयागराज: पुलिसकर्मियों के कथित रूप से निजी कारोबार में शामिल होने के आरोपों पर गंभीर चिंता व्यक्त करते हुए इलाहाबाद हाईकोर्ट ने कहा है कि कुछ पुलिस थाने कानून-व्यवस्था बनाए रखने के बजाय व्यावसायिक गतिविधियों के केंद्र बनते दिखाई दे रहे हैं।

न्यायालय ने टिप्पणी की कि यदि ऐसी स्थिति बनी रही तो राज्य में प्रभावी पुलिस व्यवस्था बनाए रखना कठिन हो जाएगा।

मामले की सुनवाई करते हुए न्यायमूर्ति रोहित रंजन अग्रवाल ने उत्तर प्रदेश के पुलिस महानिदेशक (डीजीपी) को निर्देश दिया कि बलिया जिले में तैनात एक पुलिस कांस्टेबल के कथित परिवहन व्यवसाय की विस्तृत जांच कराई जाए।

अदालत ने कहा कि यह पता लगाया जाना आवश्यक है कि सेवा में रहते हुए वह किस प्रकार व्यावसायिक गतिविधियों से जुड़ा रहा।

पीठ ने केवल जांच के निर्देश ही नहीं दिए, बल्कि डीजीपी तथा उत्तर प्रदेश के अपर मुख्य सचिव (गृह) को बलिया जिले के रसड़ा थाने में तैनात सभी पुलिस अधिकारियों और कांस्टेबलों के विरुद्ध विभागीय अनुशासनात्मक कार्रवाई प्रारंभ करने का भी आदेश दिया।

अदालत ने यह भी स्पष्ट किया कि डीजीपी दस दिनों के भीतर शपथपत्र दाखिल कर न्यायालय को यह बताएंगे कि उसके आदेशों के अनुपालन में अब तक क्या-क्या कार्रवाई की गई है।

यह पूरा मामला हरेंद्र यादव द्वारा दायर उस याचिका की सुनवाई के दौरान सामने आया, जिसमें उन्होंने सहायक क्षेत्रीय परिवहन अधिकारी (एआरटीओ), बलिया द्वारा उनके ट्रक को ब्लैकलिस्ट किए जाने के आदेश को चुनौती दी थी।

अदालती अभिलेखों के अनुसार, वाहन को ब्लैकलिस्ट करने की कार्रवाई एक उपनिरीक्षक की रिपोर्ट के आधार पर की गई थी।

यह रिपोर्ट याचिकाकर्ता और रसड़ा थाने में तैनात कांस्टेबल संतोष कुमार के बीच वाहन के स्वामित्व को लेकर उत्पन्न विवाद से संबंधित थी।

सुनवाई के दौरान अदालत ने कांस्टेबल से सीधे पूछताछ की। उसने बताया कि उसने अपने सामान्य भविष्य निधि (जीपीएफ) खाते से धन निकालकर अपने भाई के नाम पर याचिकाकर्ता के साथ परिवहन व्यवसाय शुरू किया था।

उसने यह भी स्वीकार किया कि उसी व्यवस्था के तहत ट्रक खरीदा गया और उसका संचालन याचिकाकर्ता द्वारा किया जा रहा था।

रिकॉर्ड का परीक्षण करने के बाद न्यायालय ने पाया कि एआरटीओ ने वाहन को केवल उपनिरीक्षक शिवमूर्ति तिवारी द्वारा प्रस्तुत रिपोर्ट के आधार पर ब्लैकलिस्ट कर दिया था।

अदालत के अनुसार, इस संबंध में किसी स्वतंत्र या निष्पक्ष जांच का कोई संकेत अभिलेखों में नहीं मिला।

पीठ ने यह भी गौर किया कि पुलिस अधीक्षक, बलिया द्वारा दायर शपथपत्र में कहीं भी यह उल्लेख नहीं किया गया कि सेवा में रहते हुए परिवहन व्यवसाय करने के आरोपों को लेकर संबंधित कांस्टेबल के विरुद्ध कोई विभागीय कार्रवाई की गई हो।

स्थिति पर गहरा असंतोष व्यक्त करते हुए हाईकोर्ट ने कहा कि यह अत्यंत चिंताजनक है कि पुलिस थाने व्यावसायिक गतिविधियों के केंद्र बनते दिखाई दे रहे हैं।

अदालत ने कहा कि यदि पुलिसकर्मी कानून-व्यवस्था संभालने के बजाय कारोबार में व्यस्त रहेंगे तो प्रभावी पुलिसिंग की कल्पना भी नहीं की जा सकती।

न्यायालय ने आगे कहा कि उपलब्ध सामग्री से ऐसा प्रतीत होता है कि रसड़ा थाने के प्रभारी अधिकारी तथा पुलिस अधीक्षक, बलिया ने संबंधित कांस्टेबल के पक्ष में रिपोर्ट भेजकर उसे संरक्षण प्रदान किया।

इसी रिपोर्ट के आधार पर एआरटीओ ने ट्रक को ब्लैकलिस्ट किया और उसके हस्तांतरण पर रोक लगा दी।

रिकॉर्ड पर उपलब्ध दस्तावेजों और विभिन्न अधिकारियों द्वारा दाखिल शपथपत्रों का समग्र अध्ययन करने के बाद अदालत ने टिप्पणी की कि पूरे रसड़ा थाने के कामकाज में व्यावसायिक गतिविधियों की झलक दिखाई देती है और मामले की व्यापक जांच आवश्यक है।

इन्हीं परिस्थितियों को देखते हुए हाईकोर्ट ने 27 जुलाई के अपने आदेश में डीजीपी को रसड़ा थाने में कथित रूप से संचालित व्यावसायिक गतिविधियों की विस्तृत जांच कराने का निर्देश दिया।

साथ ही वहां तैनात सभी पुलिस अधिकारियों एवं कांस्टेबलों के विरुद्ध विभागीय कार्रवाई शुरू करने का आदेश भी पारित किया।

मामले की अगली सुनवाई अब 11 अगस्त को होगी। उस दिन न्यायालय जांच की प्रगति, विभागीय कार्रवाई और डीजीपी द्वारा प्रस्तुत अनुपालन रिपोर्ट का अवलोकन करेगा।
