Allahabad High Court Warns Muzaffarnagar DM of Personal Appearance Over Delay in Removing Illegal Encroachments

Prayagraj: The Allahabad High Court has expressed strong displeasure over the failure of the Muzaffarnagar district administration to act against alleged illegal encroachments on public land in Village Baroda of Budhana tehsil.

While hearing a Public Interest Litigation, the Court directed the District Magistrate to ensure compliance with its earlier directions and cautioned that continued inaction would require his personal appearance before the Bench.

The Public Interest Litigation was presented on behalf of the petitioners by advocate Miss Chhaya Gautam.

The petition concerns alleged unauthorized occupation of public land recorded as Plot Nos. 6, 59, 89, 146, 188, 203 and 379 situated in Village Baroda in Muzaffarnagar district.

During an earlier hearing held on July 16 2026, counsel for the petitioners informed the Court that two separate committees constituted by the revenue authorities had already confirmed the existence of encroachments on the disputed land.

Despite these official findings, no effective administrative action had been initiated to clear the public property.

Taking note of the submissions advanced by Miss Chhaya Gautam, the Court had granted the State Government two weeks to obtain necessary instructions from the district administration.

When the matter was taken up again on Tuesday,y the High Court found that the required instructions had still not been placed before it by the District Magistrate Muzaffarnagar despite the earlier judicial direction.

Observing that the authorities had failed to comply with its order, er the Court recorded its dissatisfaction with the delay.

Granting what it described as a final opportunity, the Bench directed the District Magistrate to furnish complete instructions within one week.

The Court further made it clear that if the directions are not complied with before the next hearing,g the District Magistrate of Muzaffarnagar shall appear in person along with all relevant official records.

The order reflects the High Court’s emphasis on protecting public land from unauthorized occupation and ensuring that administrative authorities promptly comply with judicial directions.

The matter has now been listed for further hearing on August 13 2026, when the Court will examine whether its directions have been implemented.

प्रयागराज: सार्वजनिक भूमि पर कथित अवैध कब्जों को हटाने में जिला प्रशासन की निष्क्रियता पर इलाहाबाद हाई कोर्ट ने कड़ा रुख अपनाया है।

मुजफ्फरनगर जिले की बुढ़ाना तहसील के ग्राम बड़ौदा से संबंधित जनहित याचिका की सुनवाई करते हुए न्यायालय ने स्पष्ट किया कि यदि उसके पूर्व आदेशों का पालन नहीं किया गया तो जिलाधिकारी मुजफ्फरनगर को स्वयं न्यायालय में उपस्थित होकर अभिलेखों सहित जवाब देना होगा।

याचिकाकर्ताओं की ओर से इस जनहित याचिका की पैरवी अधिवक्ता मिस छाया गौतम ने की।

याचिका में ग्राम बड़ौदा स्थित सार्वजनिक भूमि के गाटा संख्या 6 59 89 146 188 203 तथा 379 पर कथित अवैध कब्जों को हटाने की मांग की गई है।

16 जुलाई 2026 को हुई पिछली सुनवाई के दौरान याचिकाकर्ताओं की ओर से न्यायालय को बताया गया था कि राजस्व विभाग द्वारा गठित दो अलग-अलग समितियां संबंधित भूमि पर अतिक्रमण की पुष्टि कर चुकी हैं।

इसके बावजूद प्रशासन ने कब्जे हटाने के लिए कोई प्रभावी कार्रवाई नहीं की। इस पर अधिवक्ता मिस छाया गौतम की दलीलों पर विचार करते हुए न्यायालय ने राज्य सरकार को आवश्यक निर्देश प्राप्त करने के लिए दो सप्ताह का समय दिया था।

मंगलवार को जब मामला पुनः सुनवाई के लिए आया तो न्यायालय ने पाया कि पूर्व आदेश के बावजूद जिलाधिकारी मुजफ्फरनगर की ओर से अपेक्षित निर्देश प्रस्तुत नहीं किए गए।

न्यायालय ने इस स्थिति पर गंभीर असंतोष व्यक्त करते हुए कहा कि आदेशों का पालन अब तक नहीं किया गया है।

पीठ ने जिला प्रशासन को अंतिम अवसर प्रदान करते हुए एक सप्ताह के भीतर आवश्यक निर्देश दाखिल करने का आदेश दिया।

साथ ही स्पष्ट किया कि यदि अगली तिथि तक अनुपालन नहीं किया गया तो जिलाधिकारी मुजफ्फरनगर को सभी संबंधित अभिलेखों के साथ व्यक्तिगत रूप से न्यायालय में उपस्थित होना होगा।

न्यायालय के आदेश से यह स्पष्ट संकेत मिलता है कि सार्वजनिक भूमि की सुरक्षा और न्यायिक आदेशों के पालन के मामलों में प्रशासनिक जवाबदेही से कोई समझौता नहीं किया जाएगा।

अब इस मामले की अगली सुनवाई 13 अगस्त 2026 को होगी जब न्यायालय अपने निर्देशों के अनुपालन की समीक्षा करेगा।
