LONDON: Chief Justice of India Surya Kant has urged the global legal community to rethink how it confronts economic crime, pointing to the enormous volume of illicit money moving across borders and the growing sophistication of online fraud.

Addressing the closing session of the 43rd International Symposium on Economic Crime in London on Saturday, the CJI used the scale of global money laundering to illustrate the magnitude of the challenge.

He said the amount of money laundered worldwide each year could be enough to purchase a basic laptop for each of the roughly eight billion people on Earth.

Yet the recovery of such wealth remains strikingly limited.

Kant said that even under a generous assessment, authorities recover less than one per cent of the money that is laundered.

The enormous gap between the money moved illegally and the assets eventually recovered, he suggested, remains one of the central weaknesses in the fight against financial crime.

The Chief Justice also drew attention to the increasingly international nature of illicit wealth.

Criminal proceeds, he noted, do not necessarily remain in the country where they were generated, making cooperation between jurisdictions crucial when investigators seek to trace and recover assets.

In this context, Kant highlighted the role of Mutual Legal Assistance Treaties (MLATs).

He said international mechanisms for judicial assistance, despite their procedural limitations, can provide a more dependable route for recovering and returning illicit assets than extradition proceedings.

He also pointed to changes in India’s own legal response to economic offences.

Referring to the Insolvency and Bankruptcy Code, 2016, Kant said insolvency proceedings can operate alongside criminal cases, allowing efforts to recover assets to continue even when criminal trials take considerable time.

The CJI used the example of so-called digital arrest scams to illustrate why the justice system cannot always wait for legislation to catch up with new forms of criminality.

In these frauds, criminals pose as police officers, judges, government officials or other authorities, often using video calls to create the appearance of a genuine investigation.

Victims are then pressured into transferring money or surrendering control of their savings.

Kant said the judiciary has already sought an assessment of the scale of the digital-arrest problem by the Union government and state authorities.

He also said the court has advocated the creation of a specific offence dealing with such conduct, accompanied by penalties that reflect the financial and personal damage caused to victims.

For the Chief Justice, the issue represents a broader shift in the way courts must deal with economic crime.

Emerging fraud techniques can evolve faster than formal legislative processes, making judicial intervention and institutional coordination increasingly important.

He described India’s contemporary approach to economic crime as a system built on several interconnected layers.

Laws, enforcement institutions and judicial principles, he said, have developed over time, with each serving a different function in tackling complex financial offences.

Kant’s remarks placed particular emphasis on the need to make asset recovery a more effective component of international justice.

Tracking criminal money across borders, preventing its disappearance into complex financial structures and ultimately returning recovered assets to the country of origin remain difficult tasks for authorities worldwide.

The challenge, his comments suggested, is no longer simply identifying economic offenders.

It is also about ensuring that illegally acquired wealth can be traced, frozen and recovered before it disappears beyond the reach of investigators.

लंदन: दुनिया भर में आर्थिक अपराध जिस तेजी और जटिलता के साथ बढ़ रहे हैं, उन्हें रोकने के लिए केवल पारंपरिक कानूनी उपाय पर्याप्त नहीं होंगे।

भारत के मुख्य न्यायाधीश सूर्यकांत ने अंतरराष्ट्रीय स्तर पर मनी लॉन्ड्रिंग और नए तरह के डिजिटल धोखाधड़ी के मामलों से निपटने के लिए अधिक सक्रिय न्यायिक और संस्थागत प्रतिक्रिया की जरूरत बताई है।

लंदन में शनिवार को आयोजित 43वीं इंटरनेशनल सिम्पोजियम ऑन इकोनॉमिक क्राइम के समापन सत्र में बोलते हुए CJI ने वैश्विक मनी लॉन्ड्रिंग के पैमाने को समझाने के लिए एक व्यापक उदाहरण दिया।

उन्होंने कहा कि एक वर्ष में दुनिया में अवैध रूप से धन को वैध बनाने का अनुमानित पैमाना इतना बड़ा है कि उससे पृथ्वी पर मौजूद करीब आठ अरब लोगों में से प्रत्येक के लिए एक साधारण लैपटॉप खरीदा जा सकता है।

लेकिन इस विशाल रकम का बेहद छोटा हिस्सा ही वापस हासिल हो पाता है।

सूर्यकांत ने कहा कि उदारतम अनुमान के आधार पर भी लॉन्डर किए गए धन के प्रत्येक 100 हिस्सों में से एक से कम हिस्सा अधिकारियों के हाथ वापस आता है।

उनके अनुसार, आर्थिक अपराध की सबसे बड़ी मुश्किलों में से एक यह है कि अपराध से हासिल धन अक्सर उस देश में नहीं रहता जहां से उसे हासिल किया गया था।

सीमा पार वित्तीय नेटवर्क और अलग-अलग न्यायक्षेत्रों के कारण ऐसे मामलों में जांच और संपत्ति की वापसी दोनों जटिल हो जाती हैं।

इसी संदर्भ में CJI ने देशों के बीच म्यूचुअल लीगल असिस्टेंस ट्रीटी (MLAT) की उपयोगिता पर जोर दिया।

उन्होंने कहा कि इन व्यवस्थाओं में खामियां और प्रक्रियात्मक अड़चनें हो सकती हैं, फिर भी अवैध संपत्ति को खोजकर उसके मूल देश तक वापस पहुंचाने में ये तंत्र कई बार प्रत्यर्पण की तुलना में अधिक भरोसेमंद साबित होते हैं।

भारत में आर्थिक अपराधों से निपटने की व्यवस्था का उदाहरण देते हुए उन्होंने इन्सॉल्वेंसी एंड बैंकरप्सी कोड, 2016 का भी उल्लेख किया।

उनके मुताबिक, दिवालिया प्रक्रिया और आपराधिक मुकदमा समानांतर रूप से आगे बढ़ सकते हैं।

इससे आपराधिक सुनवाई में समय लगने के बावजूद संपत्ति की वसूली की प्रक्रिया को जारी रखने की गुंजाइश रहती है।

CJI ने तेजी से फैल रहे ‘डिजिटल अरेस्ट’ घोटालों को भी नई तरह की चुनौती के तौर पर सामने रखा।

इस तरह की ठगी में अपराधी खुद को पुलिस अधिकारी, न्यायिक अधिकारी, सरकारी अफसर या किसी अन्य प्रभावशाली प्राधिकरण का प्रतिनिधि बताकर लोगों से संपर्क करते हैं।

अक्सर वीडियो कॉल के जरिए पीड़ित को यह विश्वास दिलाया जाता है कि वह किसी आपराधिक जांच में फंस गया है।

इसके बाद डर और दबाव का इस्तेमाल करके उससे बैंक खातों से पैसे ट्रांसफर कराने या उसकी जमा पूंजी हासिल करने की कोशिश की जाती है।

सूर्यकांत ने कहा कि इस समस्या का वास्तविक दायरा समझने के लिए केंद्र और राज्यों को स्थिति का आकलन करने के निर्देश दिए गए हैं।

न्यायपालिका ने ऐसे मामलों के लिए अलग अपराध की व्यवस्था और नुकसान की गंभीरता के अनुरूप सजा तय करने की आवश्यकता पर भी जोर दिया है।

उन्होंने इसे न्याय व्यवस्था के सामने उभर रही एक बड़ी चुनौती का उदाहरण बताया। अपराध के नए तरीके कई बार कानून बनने की प्रक्रिया से ज्यादा तेजी से विकसित होते हैं।

ऐसे में न्यायपालिका और दूसरी संस्थाओं को बदलती परिस्थितियों के अनुरूप प्रतिक्रिया देने की जरूरत होती है।

CJI ने भारत में आर्थिक अपराधों से निपटने की व्यवस्था को कई स्तरों पर विकसित हुई संरचना के रूप में बताया।

उनके अनुसार, कानून, जांच एवं प्रवर्तन संस्थाएं और न्यायिक सिद्धांत समय के साथ अलग-अलग भूमिकाओं के साथ विकसित हुए हैं और इनका संयुक्त इस्तेमाल जटिल आर्थिक अपराधों से निपटने में किया जा सकता है।

उनके संबोधन का एक महत्वपूर्ण पक्ष अवैध संपत्ति की वसूली और वापसी को अधिक प्रभावी बनाने की जरूरत थी।

विदेशों में पहुंच चुके धन का पता लगाना, उसे फ्रीज कराना और अंततः मूल देश को वापस दिलाना आज भी दुनिया की कानून प्रवर्तन एजेंसियों के लिए बड़ी चुनौती बना हुआ है।

सूर्यकांत के विचारों का व्यापक संदेश यही रहा कि आर्थिक अपराध के खिलाफ सफलता केवल अपराधी की पहचान और गिरफ्तारी से नहीं मापी जानी चाहिए।

असली चुनौती यह सुनिश्चित करना है कि अपराध से हासिल संपत्ति जांच की पहुंच से बाहर न चली जाए और उसे प्रभावी अंतरराष्ट्रीय सहयोग के जरिए वापस हासिल किया जा सके।
