Supreme Court Questions Mahua Moitra’s Virtual Appearance Plea, Refuses to Interfere with High Court Order
The Supreme Court dismissed as withdrawn a petition filed by TMC MP Mahua Moitra seeking permission to appear virtually before the investigating officer in a criminal case. The court questioned the grounds cited for the request while leaving the Calcutta High Court’s order unchanged.

New Delhi: The Supreme Court on Friday expressed reservations over Trinamool Congress MP Mahua Moitra’s request to participate through video conferencing in a criminal investigation, observing that public representatives should not be deterred by the possibility of protests while discharging their legal responsibilities.

During the hearing, Justice Dipankar Datta remarked that individuals who choose public life must be prepared to face criticism and resistance.

Drawing a comparison with India’s freedom movement, the judge observed that freedom fighters had endured far greater hardships, including facing bullets, while fighting for the nation’s independence.

The Bench, comprising Justice Dipankar Datta and Justice Sheel Nagu, also questioned the necessity of bringing the matter before the country’s highest court.

Following the court’s observations, senior advocate Gopal Sankaranarayanan, appearing for the Lok Sabha member, sought permission to withdraw the petition.

The Bench thereafter dismissed the matter as withdrawn.

The legal dispute arose from a First Information Report registered against Mahua Moitra on allegations of hurting religious sentiments through a social media post.

Earlier, the Calcutta High Court had declined to quash the FIR but acknowledged that the parliamentarian would remain engaged in the ongoing Monsoon Session of Parliament until August 13.

Accordingly, the High Court directed her to appear before the investigating officer on August 14.

The High Court had also directed investigating authorities not to adopt any coercive measures against Moitra during her appearance and instructed that adequate arrangements be made to prevent any harassment or disturbance from demonstrators.

Before the Supreme Court, Moitra’s counsel argued that the proceedings related only to a Facebook post and requested that she be allowed to cooperate with the investigation through video conferencing instead of appearing physically before the investigating officer.

Questioning the basis of the request, Justice Datta asked why a virtual appearance should be permitted merely because the petitioner is a Member of Parliament.

Responding to the court’s query, the senior advocate submitted that legal safeguards provide certain protections to specific categories of individuals, including women, allowing them to participate in investigations from their place of residence under prescribed circumstances.

The counsel further referred to an earlier visit to the constituency, claiming that she had faced hostile protests during that occasion.

He informed the court that threats of egg-pelting had been issued beforehand and that eggs were subsequently thrown when she appeared before the public.

After hearing the submissions, the Supreme Court declined to interfere with the order passed by the Calcutta High Court, leaving its directions unchanged.

नई दिल्ली: सुप्रीम कोर्ट ने शुक्रवार को तृणमूल कांग्रेस सांसद महुआ मोइत्रा की उस मांग पर गंभीर सवाल उठाए, जिसमें उन्होंने एक आपराधिक जांच के दौरान जांच अधिकारी के समक्ष वीडियो कॉन्फ्रेंसिंग के माध्यम से उपस्थित होने की अनुमति मांगी थी।

अदालत ने टिप्पणी की कि सार्वजनिक जीवन में सक्रिय जनप्रतिनिधियों को विरोध या प्रदर्शन की आशंका के कारण अपने कानूनी दायित्वों से पीछे नहीं हटना चाहिए।

सुनवाई के दौरान न्यायमूर्ति दीपांकर दत्ता ने कहा कि राजनीति में आने वाला व्यक्ति सार्वजनिक प्रतिक्रिया का सामना करने के लिए तैयार रहता है।

उन्होंने स्वतंत्रता संग्राम का उल्लेख करते हुए कहा कि देश के स्वतंत्रता सेनानियों ने राष्ट्र के लिए अपने सीने पर गोलियां तक झेली थीं, इसलिए केवल विरोध प्रदर्शन की आशंका को आधार नहीं बनाया जा सकता।

न्यायमूर्ति दीपांकर दत्ता और न्यायमूर्ति शील नागू की पीठ ने यह भी कहा कि इस प्रकार का मामला सर्वोच्च न्यायालय तक लाने की आवश्यकता नहीं थी।

अदालत की टिप्पणियों के बाद महुआ मोइत्रा की ओर से वरिष्ठ अधिवक्ता गोपाल शंकरनारायणन ने याचिका वापस लेने की अनुमति मांगी, जिसे स्वीकार करते हुए न्यायालय ने याचिका को वापस लिया हुआ मानकर समाप्त कर दिया।

यह मामला महुआ मोइत्रा के विरुद्ध दर्ज उस प्राथमिकी से जुड़ा है जिसमें उन पर सोशल मीडिया पर की गई एक पोस्ट के माध्यम से धार्मिक भावनाएं आहत करने का आरोप लगाया गया है।

इससे पहले कलकत्ता हाईकोर्ट ने प्राथमिकी रद्द करने से इनकार करते हुए यह ध्यान में रखा था कि सांसद 13 अगस्त तक संसद के मानसून सत्र में व्यस्त रहेंगी।

इसी आधार पर अदालत ने उन्हें 14 अगस्त को जांच अधिकारी के समक्ष उपस्थित होने का निर्देश दिया था।

हाईकोर्ट ने यह भी स्पष्ट किया था कि निर्धारित तिथि पर पेशी के दौरान उनके खिलाफ कोई कठोर कार्रवाई नहीं की जाएगी तथा प्रशासन यह सुनिश्चित करेगा कि उन्हें किसी प्रकार की भीड़ या प्रदर्शनकारियों से परेशानी का सामना न करना पड़े।

सुप्रीम कोर्ट में सुनवाई के दौरान महुआ मोइत्रा की ओर से दलील दी गई कि पूरा मामला केवल एक फेसबुक पोस्ट से संबंधित है और परिस्थितियों को देखते हुए उन्हें वीडियो कॉन्फ्रेंसिंग के माध्यम से जांच में सहयोग करने की अनुमति दी जानी चाहिए।

इस पर न्यायमूर्ति दत्ता ने पूछा कि केवल सांसद होने के कारण किसी व्यक्ति को वर्चुअल माध्यम से उपस्थित होने की विशेष अनुमति क्यों दी जाए।

जवाब में वरिष्ठ अधिवक्ता ने कहा कि कानून कुछ विशेष वर्गों, विशेषकर महिलाओं, को निर्धारित परिस्थितियों में अपने निवास स्थान से ही जांच प्रक्रिया में शामिल होने का संरक्षण प्रदान करता है और इसी कानूनी अधिकार के आधार पर यह अनुरोध किया गया है।

उन्होंने अदालत को यह भी बताया कि पूर्व में अपने संसदीय क्षेत्र में जाने के दौरान महुआ मोइत्रा को विरोध का सामना करना पड़ा था।

उनके अनुसार पहले अंडे फेंके जाने की चेतावनी दी गई थी और बाद में वास्तव में उन पर अंडे भी फेंके गए थे।

सभी पक्षों की दलीलें सुनने के बाद सुप्रीम कोर्ट ने कलकत्ता हाईकोर्ट के आदेश में हस्तक्षेप करने से इनकार कर दिया। इसके साथ ही उच्च न्यायालय द्वारा जारी सभी निर्देश यथावत बने रहेंगे।
