Supreme Court Examines PIL Seeking Asset Action Against Paper Leak Networks

The top court has called for the views of the Union and state governments on a proposal to trace and attach assets linked to examination paper leak crimes, with the petitioner arguing that such fraud destroys the future of millions of students.

The Supreme Court has turned its attention to the financial dimension of examination paper leak cases, seeking responses from the Centre and state governments on a proposal to identify and confiscate assets allegedly linked to such crimes.

The public interest litigation argues that dismantling paper leak operations requires authorities to look beyond the individuals caught distributing stolen question papers and examine the money, properties and assets allegedly generated through organised examination fraud.

A bench comprising Justices P.S. Narasimha and Alok Aradhe issued notices to the Union government and the states while considering the petition. The case will be heard next on September 25.

The PIL, filed by advocate Ashwini Kumar Upadhyay through his counsel Ashwani Kumar Dubey, asks for a comprehensive assessment of assets belonging to those accused of paper leak offences.

It also seeks scrutiny of properties held by their family members where investigators find grounds to examine whether such assets are connected to the alleged proceeds of crime.

The petition has suggested that authorities use the available legal framework, including provisions dealing with corruption, money laundering, benami holdings and undisclosed wealth, wherever the facts of a particular case justify such action.

In another proposal, the petitioner has argued for stronger sentencing principles in paper leak prosecutions.

The plea suggests that punishment in separate cases should, where appropriate, run one after another rather than simultaneously.

Alternatively, it seeks a study by the Law Commission on how other countries deal with the organised leaking of examination material, followed by recommendations for India.

The petitioner did not, however, pursue one of the earlier demands made in the PIL.

During the hearing, he told the court that he was no longer pressing for judicial directions requiring fixed deadlines for investigation and trial.

This change followed the passage of the Public Examinations Amendment Bill, 2026, which further strengthens the legal framework aimed at curbing question paper leaks.

The petition places the issue in the context of the enormous human cost of compromised examinations.

According to the PIL, students often devote years to preparing for competitive tests and spend substantial amounts on coaching, applications, travel and study material. In some cases, families borrow money to finance these preparations.

A single paper leak can force an examination to be cancelled, postponed or conducted again, leaving candidates facing fresh uncertainty.

For many, particularly those approaching age limits for recruitment, the consequences can extend far beyond the loss of an examination fee.

The plea argues that repeated breakdowns in preventing and prosecuting paper leaks affect the constitutional guarantees of equality, fair access to public opportunities, personal liberty and dignified life.

It has referred to Articles 14, 16, 19 and 21 of the Constitution, claiming that the recurring failure to stop such crimes harms students who depend on examinations for admission, employment and professional advancement.

The petition also points to the emotional consequences of prolonged uncertainty, saying students can suffer severe mental and physical stress.

Families may face mounting financial obligations, while candidates risk losing valuable educational or employment opportunities.

It further highlights concerns about cases of extreme distress among students, including suicides reported in the aftermath of examination-related controversies.

Although India enacted the Public Examinations Act, 2024, to deal more firmly with unfair practices and criminal networks targeting public examinations, the petitioner has argued that gaps remained in the earlier framework, particularly on the speed with which investigations and trials should be completed.

With the Supreme Court now inviting the views of governments across the country, the litigation has raised a broader question: should those accused of profiting from a paper leak face action against the wealth allegedly created through the crime, in addition to criminal prosecution?

The answer may have important implications for how India deals with one of the most persistent threats to the credibility of competitive examinations.

परीक्षा का प्रश्नपत्र लीक होने पर कार्रवाई केवल गिरफ्तारियों और जेल की सजा तक सीमित रहनी चाहिए या अपराध से जुड़े कथित आर्थिक लाभ को भी निशाना बनाया जाना चाहिए—सुप्रीम कोर्ट के समक्ष दायर एक जनहित याचिका ने यही बड़ा सवाल उठाया है।

याचिका पर सुनवाई करते हुए शीर्ष अदालत ने केंद्र सरकार और राज्य सरकारों से जवाब मांगा है।

याचिकाकर्ता ने मांग की है कि पेपर लीक में शामिल लोगों की कथित अवैध कमाई और उससे बनाई गई चल-अचल संपत्तियों का पता लगाकर कानून के अनुसार कार्रवाई की जाए।

न्यायमूर्ति पी.एस. नरसिम्हा और न्यायमूर्ति आलोक अराधे की पीठ ने मामले में नोटिस जारी किया। अदालत अब 25 सितंबर को इस याचिका पर आगे सुनवाई करेगी।

याचिका का मुख्य तर्क यह है कि पेपर लीक को एक संगठित आर्थिक अपराध की तरह भी देखा जाना चाहिए। यदि जांच में यह सामने आता है कि अपराध से पैसा कमाया गया और उससे संपत्तियां बनाई गईं, तो संबंधित कानूनी प्रावधानों के तहत उन संपत्तियों की जांच और जब्ती की व्यवस्था होनी चाहिए।

अधिवक्ता अश्विनी कुमार उपाध्याय की ओर से दायर याचिका में कथित आरोपियों की कुल संपत्ति का आकलन करने की मांग की गई है।

साथ ही, परिवार के सदस्यों के नाम पर मौजूद उन परिसंपत्तियों की भी जांच का सुझाव दिया गया है, जिनके संबंध में अपराध की आय से जुड़े होने का आधार मौजूद हो।

याचिका में भ्रष्टाचार, धन शोधन, बेनामी संपत्ति और काले धन से जुड़े कानूनों का उपयोग परिस्थितियों के अनुसार करने का आग्रह किया गया है।

पेपर लीक के मामलों में सजा को लेकर भी याचिका में सख्त रुख अपनाने की मांग की गई है। इसमें सुझाव दिया गया है कि यदि किसी व्यक्ति को एक से अधिक मामलों में दोषी पाया जाता है तो उचित परिस्थितियों में उसकी सजा एक साथ चलने के बजाय क्रम से पूरी कराई जाए।

याचिकाकर्ता ने एक वैकल्पिक सुझाव भी रखा है।

इसके अनुसार, विधि आयोग को विभिन्न देशों की व्यवस्थाओं का अध्ययन कर यह बताना चाहिए कि परीक्षा संबंधी अपराधों और प्रश्नपत्र चोरी के मामलों में कौन से प्रभावी कानूनी उपाय अपनाए जाते हैं।

हालांकि, समयबद्ध जांच और मुकदमे से संबंधित मांग पर याचिकाकर्ता ने अब जोर नहीं दिया है।

सुनवाई के दौरान अदालत को बताया गया कि सार्वजनिक परीक्षाओं से जुड़े कानून को और कड़ा करने वाला सार्वजनिक परीक्षा संशोधन विधेयक, 2026 पारित हो चुका है, इसलिए उस राहत को फिलहाल आगे नहीं बढ़ाया जा रहा।

याचिका में यह भी रेखांकित किया गया है कि पेपर लीक का सबसे बड़ा बोझ उन विद्यार्थियों और अभ्यर्थियों पर पड़ता है, जिन्होंने वर्षों की तैयारी के बाद परीक्षा दी होती है।

प्रतियोगी परीक्षाओं की तैयारी में छात्रों और परिवारों का समय, धन और मानसिक ऊर्जा लगते हैं।

कोचिंग, अध्ययन सामग्री, आवेदन शुल्क, यात्रा और रहने जैसे खर्च कई परिवारों के लिए भारी होते हैं। कुछ लोग इन जरूरतों को पूरा करने के लिए कर्ज तक लेते हैं।

ऐसे में यदि प्रश्नपत्र लीक होने के कारण परीक्षा रद्द हो जाती है या दोबारा आयोजित करनी पड़ती है, तो अभ्यर्थियों की योजनाएं महीनों या वर्षों तक पीछे जा सकती हैं।

सरकारी नौकरी की आयु सीमा के करीब पहुंच चुके उम्मीदवारों पर इसका असर और अधिक गंभीर हो सकता है।

याचिका का कहना है कि बार-बार होने वाली ऐसी घटनाएं निष्पक्ष अवसर और समानता की संवैधानिक व्यवस्था पर भी प्रश्न खड़े करती हैं।

इसमें अनुच्छेद 14, 16, 19 और 21 का उल्लेख करते हुए कहा गया है कि परीक्षा व्यवस्था की विफलता शिक्षा, रोजगार और सम्मानजनक जीवन से जुड़े हितों को प्रभावित कर सकती है।

परीक्षा रद्द होने, परिणामों में देरी और बार-बार तैयारी करने की मजबूरी से छात्रों में गंभीर मानसिक दबाव पैदा हो सकता है।

याचिका में आर्थिक संकट, अवसरों के नुकसान और परीक्षा विवादों के बाद सामने आने वाली आत्महत्या की घटनाओं का भी उल्लेख किया गया है।

भारत में सार्वजनिक परीक्षाओं की विश्वसनीयता बनाए रखने के लिए 2024 में कानून बनाया गया था, लेकिन याचिका में कहा गया है कि पुराने कानूनी ढांचे में कुछ व्यावहारिक कमियां बनी हुई थीं। विशेष रूप से जांच और मुकदमों की गति को लेकर चिंता जताई गई थी।

अब केंद्र और राज्य सरकारों के जवाब के बाद सुप्रीम कोर्ट के समक्ष यह सवाल और स्पष्ट रूप से आएगा कि पेपर लीक जैसे अपराधों के खिलाफ लड़ाई में केवल अपराधियों की पहचान और सजा पर्याप्त है या कथित रूप से अपराध से अर्जित संपत्ति तक पहुंचना भी जरूरी है।

मामले की अगली सुनवाई 25 सितंबर को होगी।
